The meeting was called to order by Mayor Pro Tempre Maxwell at 6:30 p.m. All flour Coundl members v~rere in attendance, as was City Manager Steve Mielke. Mayor fZedepenning was abserrt. R fuse I~w--In~rlachen Park The first item of discussion was the reuse issue-Inberlad~en Park. City Manager Steve Mielke reviewed the history of this issue, indk~tlng that three neighbors within the Interlachen Park neighbortrood were in dispute over the placemerrt of refuse. recyding. and brush pkaaup by one of the neighbors. The City Coundl had scheduled this for a discussion at the work sessbn to determine the dty's position reladve to the Issue, and to determine whether or nat the Issue was handled appropriately according do pdicy. City Attorney Jerre M81er reviewed a memorandum with the Coundl outlining his positlon relative to this issue. City Attorney indicated that he had reviewed the various documents presented to him, inducting a driveway easerrierrt, and determined the issue was one of a private nature, nat public and that the City should not intervene in the dispute. After discussion. it was the Counc~'s consensus that the staff should send a letter reiterating the positlon stated by Public Works Director Steve Stadler, and again suggest mediatlon as a way of resolving the issue. Additionally. they determined that they wish to stay with the e~dstlng pdicy document, and ooncurned with the statements and opinions of the City Attorney. City Manager Steve Mielke reviewed with the Coundl the events from the Pdtce Civil Service Commission meeting. which had been held earlier that day. He provided the Coundl with an outline of a draft process that the Commissbn was considering. Due to the City Councl meeting scheduled for 7:30 p.m.. the Coundl chose to suspend this meeting and to reconvene the work session after the City Coundl mee~tlng. The meeting was suspended at 7:25 p.m. The work session was reconvened at 8:50 p.m. City Manager Steve Mielke contlnued the dist:ussbn outlining the Commissbn's desire to begin development of the position profile. and Indicating that the Brtmeyer Group would be hired to conduct that effort. CouncR was ado informed that they would provide input to the Commissbn by helping to develop the positlon praf~e, and that and r the current draft process. they would also be inducted in the interview process. City Manger Mielke indicated that he would be speaking soon with the d,alr of the Commission, Rk;k Br~wsen, and would discuss tow to impnotie communications. County Road S Project The Coundl then discussed the County Road 3 project stating that the earlier response to Mr. Been should have included a statement that the Country Road 3 project is a county project and they have control oaf oontr~+c.~tor actions. l.rea~ Pidaup A request was made to update the Courd on the decisions regarding leaf pkiaups, esplaining why we use the special process for collection in some neighbort~oods and do clarify the dates that wane determined by the City CourxS. The Coundl also requested that these esplanatlons be used in upcoming advertlsing of the program. Aaoe~ibllMy oaf Biks Trails Courd member Jensen indicated that she had spoken do someone at Sonorrra Apartrnents who had indicated oorroem about the bike trais and the airb cuts accessing the bike trails being diffbult to tr~werse for a wheelchair. She asked that the Issue be considered and suggested a call do the manager of the Sonoma Apartments ~ get m~one detaNs about the issue. Councq member Jensen krdicatied that she had seen a near accident at the crossing ofi County Road 3 and the Hennepin Parks traA. She asked that the staff look at sign~e along that road and do investlgate butter ways of mautdng the county road so that vehkie drivers would be more cognizant oaf the traN crossing. She acknowledged that whie thane was signage, it was inadequate and too dose to the crossing to be eSedive. Clly Manager PerRorman©e Package SteMe Mielke indicated that he was stlll woriing on the perf~orm~anoe pacicsge discussed during his evaluatbn and that while the Mayor had been pushing him to develop the package, time constraints and other pnojek~ts made this issue a lower priority and ther+e~fiore, had rat yet been completed.
