01-05-99A regular m sting of th Hopkins City Council was held on January 5, 1999, in the
Council Chambers of the Hopkins City Hall.
Present were Mayor Redepenning and Council Members Maxwell, Jansen, Hesch, and
Johnson. Also present were staff members Mielke, Gensllie, Stadler, Kerrigan,
Elvarum, and City Attorney Jerre Miller.

Mayor Redepenning called the meeting to order at 7:32 p.m.

Mayor Redepenning asked Karsten Elverum to review Ordinance 98-822. Council
Member Johnson made a correction to the minutes of December 15th, on page three,
last paragraph, to change "The motion carried unanimously" to "The motion carried".
Steve Mielke reviewed the Transit Service Sector Study, saying that the total cost of
the second phase of this study is about ~ 125,000. The Met Council will pay the first
S 100,000 leaving X25,000 to ba shared by the participating cities, based' on
population. Hopkins share will be approximately #3,500. This is in comparison to the
original estimate of $35,000.
Council Member Hesch moved and Council Member Johnson seconded a motion to
approve the consent agenda with the mentioned changes to the minutes of December
15, 1998. A poll of the vote was as follows: Council Member Maxwell, aye; Council
Member Jensen, aye; Council Member Hesch, aye; Council Member Johnson, aye;
Mayor Redepenning, aye. The motion carried unanimously.

IV. PUBLIC HEARING
1. Housing Improvement Fees for Housing Improvement Area 3 -Valley Park
Condominiums (CR99-004)
Kersten Elverum, Housing Coordinator, told the Council that the City of Hopkins has
the authority to establish a housing improvement area and, within that area, the City
can sell bonds to finance various improvements. The Valley Park Condominiums
Board of Directors has identified the improvements proposed to be financed. The
total amount of the improvements is $1,575,000. Ms. Elverum reviewed the
procedure and the time line.
Mayor Redepenning opened the public hearing at 7:40 p.m.
Rusty Fifield, Ellers and Associates, appeared to answer questions.
Robert Druskin, 903 - 11 to Ave S, #5, asked if the payments would be monthly,
annually, or semi-annually. Mr. Fifield said that the balance would be added to the
real estate tax statement and that it would depend on how each individual paid their
taxes.
Council Member Maxwell moved and Council Member Johnson seconded a motion to
close the public hearing. The public hearing was closed by unanimous consent at
7:42 p.m.
Council Member Maxwell moved and Council Member Jensen seconded a motion to
adopt resolution 99-002, approving housing improvement fees for Housing
Improvement Area 3 -Valley Park Condominiums and authorize staff to prepare
development agreement. A poll of the vote was as follows: Council Member
Maxwell, aye; Council Member Jensen, aye; Council Member Hesch, aye; Council
Member Johnson, aye; Mayor Redepenning, aye. The motion carried unanimously.
V. NEW BUSINESS
1. Contract for Single Family Housing Study (CR99-002)
Jim Kerrigan said that the City Council recently approved a moratorium prohibiting the
issuance of permits for the demolition of single family homes within single family-
zoned areas. Mr. Kerrigan said that during the time of the moratorium, it is proposed
that a study be undertaken to review the issue in more detail.
A discussion followed. Council Members asked that this item be put on the work-
session agenda in February.

Council Member Hesch moved and Council Member Jensen seconded a motion to
execute a contract with Hoisington Koegler and Associates, dated December 28,
1998, to undertake a study concerning the preservation of single family housing stock
in the City of Hopkins. A poll of the vote was as follows: Council Member Maxwell,
aye; Council Member Jensen, aye; Council Member Hesch, aye; Council Member
Johnson, aye; Mayor Redepenning, aye. The motion carried unanimously.
2. Set Hearing Date, Liquor License Violation -Hopkins Bowl
Steve Mielke said that a procedure was established for considering civil penalties for
liquor license violations. A criminal violation involving the sale of alcohol to a minor
by an employee who entered a plea of guilty occurred. Mr. Mielke said that the City
Manager tried to negotiate a civil penalty without success. The licensee asked for a
hearing to determine if a penalty was warranted.
City Attorney Jerre Miller explained the hearing process.
A discussion followed.
Justin Racey, a student from Hopkins West Jr. High School, said that he didn't
understand why the licensee was being penalized for what the employee did. Mr.
Mielke explained that when the license was applied for, the licensee agreed to be
responsible for the actions of the employees.
Council Member Maxwell moved and Council Member Johnson seconded a motion to
set a hearing on January 19, 1999, at 6:30 p.m. in the Raspberry Room of the
Hopkins City Hall for the purpose of determining whether to impose a civil penalty
against the on-sale liquor license for the Hopkins Bowl. A poll of the vote was as
follows: Council Member Maxwell, aye; Council Member Jensen, aye; Council
Member Hesch, aye; Council Member Johnson, aye; Mayor Redepenning, aye. The
motion carried unanimously.
3. Feasibility Report, Order Public hearing - 1999 Alley Improvements (CR99-
210)
Steve Stadler said that at its December 1 meeting, the City Council authorized a
feasibility study concerning the reconstruction of alleys in North Hopkins in the 300
block between 12th and 13th Avenues N and the 400 block between 14th and 15tH
Avenues N. The report recommends reconstruction with concrete with a proposed
cost of 530,400 for Block 400 and 547,000 for Block 300.
Council Member Johnson moved and Council Member Hesch seconded a motion to
adopt Resolution 98-094, Resolution Ordering Public Hearing, Alley Reconstruction,
Project 98-14. A poll of the vote was as follows: Council Member Maxwell, aye;

Council Member Jensen, aye; Council Member Hesch, aye; Council Member Johnson,
aye; Mayor Redepenning, aye. The motion carried unanimously.
VI. REPORTS -COMMITTEES/COMMISSIONS
Council Member Johnson said that she did not attend the Chemical Health
Commission, but had a report that the grant that the Commission applied for to cover
the cost of the retail kits being put together for liquor licensees, was denied. They
are still seeking funds from other sources. The Commission is also working on the
Town Meeting and has contacted Lt. Governor Schunk to appear.
Council Member Hesch said that the Zoning and Planning Commission had a good
discussion on a variance request for garage height and is looking at ways to re-write
the ordinances on building heights.
Council Member Maxwell said that the Caring Youth Awards will be on February 1 1 to
at the Minnetonka Community Center.
