09-19-95_ A regular meeting of the Hopkins City Council was held on Septs~her
19, 1995, in the Council ~~+~~3rs of Hopkins City Hall.
Present were Mayor Redepenninq, Counci~~~+t:ers Anderson, Hesch, and
Maxwell. Also present were staff m~r-xs Genellie, Kerrigan, and City
Attorney Jerre Miller. Counci~~A~~~*' Krit$ler was absent.
I. CALL TO ORDER
Mayor Redepenning called the meeting to order at 7:30 p.m.

III. CONSENT AGENDA

Counci~~~~3r Hesch moved and Counci~~~onr~r Anderson seconded a motion
to approve the consent agenda. A poll of the vote was as follows:

IV. OLD BUSINESS
A. CONSIDffit ACTION - ANIMAL ORDINANCE (CR95-161)
Jim Genellie reported the results of the survey he completed. He
answered questions from the Council about animal ordinances that other
cities have and the costs associated with enforcing these ordinances.
He also submitted an opinion from inn Curtiss, City Attorney, stating
that citisens do have the right to trap animals on their property.
Staff recommended a motion to continue the second reading of Ordinance
95-773.
Counci~~A~r..r Maxwell moved and Councilmember Anderson seconded a
motion to continue the second reading of Ordinance 95-773 until the
Regular Council Meeting on October 17, 1995.
A poll of the vote was as follows: Councilmember Anderson, Aye;
Counci~~+~her Hesch, Aye; Councilmember Maxwell, Aye; Mayor
Redepennfnq, Aye. The motion was carried unanimously.
Council directed Mr. Genellie to do further research to establish if
the City can write an ordinance to reduce the liability for residents
who trap without increasing liability to the City and if an Animal
Control Ordinance that includes cats has decreased the number of
complaints in those cities that have adopted such an ordinance.

Council further directed Mr. Genellie to enquire if the cities of
Minnetonka and Edina have an interest in providinq.Animal Control
services to the City of Hopkins under contract.
V. NEM BUSINESS
A. CONSIDER ACTION - PARKING LOT IMPROVEMENTS--EIGHTH AVENUE
AND MAINSTREET (CR95-160)
Staff recommended a motion to authorize preparation of plans and
specifications for parking lot improvements on the City/HRA property
located at the northeast corner of Mainstreet and Eighth Avenue.
Counci~~+~~~er Maxwell moved and Councilr~p~her Hesch seconded a motion
to authorize preparation of plans and specifications for parking lot
improvements on the City/HRA property located at the northeast corner
of Mainstreet and Eighth Avenue.

B. CONSIDER ACTION - SOUTH METRO PUBLIC SAFETY TRAINING CENTER
(CR95-163)
Staff recommended a motion that Hopkins be one of the cities included
in making applications and requests for capital funds for the South
Metro Public Safety Training Center.
Counci~~~her Anderson moved and Counci~~~her Maxwell seconded a
motion to approve the inclusion of Hopkins in making applications and
requests for capitol funds for the South Metro Public Safety Training
Center.

Redepenning, Aye. The motion was carried unanimously.
CONSIDER ACTION - RELEASE OF EASEMENT--ECHO PARK ADDITION
(CR95-165)
Counci~~~r~r •Anderson moved and Council~~~~:x Hesch seconded a motion
to release the easement.

D. DISCUSSION - LANFUL GALLING POLICY (MEMO)
Mr. Jim Genellie introduced the policy and explained that
Councilmember Hesch requested that Council discuss the present policy.
Counci~~~~her Hesch explained that she has been reviewing the laws
concerning charitable gambling. She stated that she will be talking
to Senator Ted Mondale regarding the amount of revenue that the State

acquires through charitable gambling. She vas concerned that the
present policy followed by the City requires local addresses, but, not
local distribution. She further stated that she would prefer having
the policy require local distribution, not necessarily local
addresses.
Brad Johnson, Gambling Manager for the Hopkins Jaycees, stated that
50$ of the revenue goes to the State and they distribute 80$ of the
available funds in the local trade area.
Mr. Gene Mright, Hopkins Family Bowl, distributed a letter and
financial statements from Celebrity Bovl Charities to the Council. He
requested that Council consider making a change to the Charitable
Gambling Policy to require 80$ contributions to the local area and
remove the requirement of a local address.
VIII. REPORTS - COMMITTEES/COMMISSIONS
Counci~~~~~r Maxwell reported that the Park Board met on Monday,
September 18, 1995~and that the Hockey Association withdrew their
request for the an ice arena for the Mighty Ducks.
Councilmember Hesch reported that the Depot Coffee House Committee has
interviewed three people for the coordinator position and that Dave
Johnson will be working with the students to select one of the three.
She also stated that they will be seeking funds for the .project and
that a number of people have expressed an interest in the project.
IX. ADJOURNMENT
Counci~~+~~ber Maxwell moved and Counci~~a~~er Anderson seconded the
motion to adjourn. The meeting was adjourned by unanimous consent at
9:00 p.m..
