Present were Mayor Barg, Councilmembers Anderson, Shirley, ~itsler and Radepenninq. Also present were staff members l~ielka, Genallia, Harmening, Gustafson, Gessele and xerrigan. I. CALL TO ORDER Mayor Berg called the meeting to order at 7:30 p.m. II. PRESENTATION M`r. Mielke and ~. The Council rill than have a resolution before it for the adoption of the assessment roll. Jim Gassale gave an overviap of the assessments. He also stated that the City had received a total of 10 appeals prior to the meeting lrlayor Barg opened the public ~+p~rinq at 7:49 p.m. Marilyn Coons, Oarnar, stated that she rents her ~~erty and is not making ands meat noN. The property has declined in value. She stated that she paid $48,900 n 1981 and the property is nor valued at $aa,900. 1~hat Frith taYe_ and upkeep of the unit she doss not feel she can afford to put anymore money into the property. Sha also stated that she does not think the improvements gill benefit the property. Mayor Barg raspond~ that the decision to make the improvements aas made by the l~ieadorbacook Association by a signed petition Kith over 65~ of the o~rners. He also stated that Kith the improvaaants the assessed value in the future should mace a positive impact on the value of the homes. l41+~ron McRisson, Owner, said that she o~rns tNO pieces of pro~.-*~ty and rents them. She stated that with the depreciation of her ~~~~erty she does not feel she can afford to pay the additional amounts assessed against her property. She said that one unit had been vacant for three months and that she pays $x83.98 a month in dues for the upkeep of the property. Sha also stated that she foals that the City should pay at least 50~ of the costa of road repair thereby lessening the assessments against the property o~rners. February a, 1993 Page 3 Angela ~ ~~se, Owner, stated that the original estimated cost vas about $750 and she is being assessed $1500. She said that is unacceptable. Jim Gessele e~cplained hoN estimates were first made. Ha also stated that the payments would be about $a76 the first year in 1994 and would drop down to $17Z in 1995 on the hie3b~r assessments and on the lvwar assessment it would amount to about $a30 the first year and drop dawn to $13a yearly after that tiaa. She stated that she is appealing on the value of the assessment. She also stated that should the pr~~..~ Ly be sold the assessment would Head to be paid off. Mayor Barg responded that it could be worked out with the buyer unless a new mop 1.~~-qa vas taken out on the property. Jos Crusiak, Owner of four units, stated that soma of the ranters are not able to pay the rent due to the economy and the project could be done at a lower cost by using overlays, etc. 8e said that due to lower values of the property and high dues he would find it a hardship to have the additional costs assessed to his properties Ise Gustafson responded that if the City is to assume the responsibility for the upkeep of the roads that' do not want to do s poor job on the roads. T'harafora, the City must build solid streets that do not need constant repair. Doug Strandness, Manager of Meadorbrook, stated that nobody is happy with the costs and that they are i/3 over the original estimate. He stated that the overall feeling of the awnars vas that the design should not ba campramdisad. This information came at the annual meeting in December. He also stated that nobody suggested that the project should stop. 8e also stated that the Board of Directors in firmly in support of the project. Ha also stated that going forward with the project should sake a positive impact on the Yia~erty. The street in its currant condition is vary bad and that the Association had concerns over insurance being cancelled and the F8A mortgage cartif ication. Finally ha said that special assessments are the only feasible Nay to getting the project done. • February 2, 1993 Page 4 1~layor Dig stated that the Springstead study did estimate the project at a lawar price but did not take into consideration the path~rays and lighting that Headed to be done. Ha stated that the City shares concern of the ~Iestbrooke area and that this is one of the las^y~s pro j acts that the City is involved in. Pat Olson, Board Director, stated that the Board firmly supports 1~. Strandnass~ statements and the proposed project Mould enhance the property values. In con junction Frith the conditional use permit submitted for an auto sales lot at 525 Nainstreat, the applicant has also raqu®sted a variance to park in the fs~st yard setback. A auto sales lot is permitted in the B-3 district Frith a conditional use permit. The COP requires a front yard setback of 20 feet for car parking. Joseph Garber appeared before the Council to state his request. He doss not rant to lose the curb cut on the corner of Sixth Avenue and Nainstraet. ~. Gustafson stated that ha could still have tiro curb cute, one on Sixth Avenue North and one on l~ainstreat. Councilme:nber Radepanninq questioned the request. 8a said that ~rhan 18r. Garber appeared before the Soninq and Planning Commdission that the problems had all been corked out. 8s stated that 1~. Gustafson had drawn a rough draft of the proposed car lot including an area for landscaping and that ~.
