Mayor Berg called the meeting to order at 7:37 p.m.

seconded the motion to ap~~rve the Consent Agenda omitting

Iv. OLD BUSINESS
Staff reca~eended the following motion: dove to a~jxt~.re
Resolution No. 93-31 ~rhich denies a conditional use permit
to operate an auto sales lot at 5a5 Mainstreet.
Mayor Berq eYplafned that their were three reasons for the
denial of the requested COP.
i. Ordinance No. 535.03 has not been cos~lied rich.
a. Ordinance No. 550.3 - City soning ordinance has not been
complied Mith.
3. The request is not consistent with the health, welfare
and safety of the City.
Tony Gleekel, Attorney for ~. Garber appeared before
Council to qo over the request by ~. Garber.
He felt that the denial needed clarifying. 8e cited several
ordinances stating that driveways did not Head a0 foot set
backs therefore the regnirametst was invalid. 8e also stated
that no there could he find anything dealing with limits of
accessibility in the ordinance. Therefore the requirement
to close the curb cut was not a reasonable condition.
Jerre 1~[iller responded that the Council has the authority to
stipulate reasonable ~~saclitions relating to health and
safety issues as a part of acting on a conditional use
permit.
After further discussion Councilaembar ~itsler moved and
Councilmamber Anderson ~~cnnded the motion to approve
Resolution No. 93-31 denying the COP.

Staff recaemended changing the May i8th Council meeting due

seconded the motion to sat the Council meeting for Nay 17,
1993 at 7:30 p.m.
A poll of the vote was as follows: Councflmambar Anderson,
Aye; Councilmember Shirley, Aye; Council ember ~Rritslar,
Aye; Councilmember Radapenninq, Aye; Mayor Berg, Aya. The
motion carried unanimously.
b. DISCQSSION - UPDATE ON NAirr~iitEET ~•~RATION
The purpose of the discussion was to provide information to
the Council on the proposed Nainstreet Days activities which
will be occurring the weekend of Nay ai st and nand.
Paul Stai~an gave a brief account of the planned
activities.
xatia Lee, staff member of the Family Resource Canter made a
brief appearance to talk about the planned activities of the
center. She said the activities would begin at 11:30 a.m.
and at a:00 O~clock p.m. their would be a ribbon cutting
ceremony in honor of the grand opening of the canter.
Stave Barbario, Childs Play Theater also made an appearance
to outline their activities. Thera will be a fun run and
open air perforaancas throt>q~~ut the day.
Councilmember Rrit$ler reminded the Council that their would
also be a book sale at the library from` 10:00 a.m. until
3:00 p.m. on Friday and Saturday, Nay asst and nand.

Staff recommended the following motion; Nova that Council
accept the feasibility report as ordered on April 6, 1993
and that Resolution No. 93-35 be adopted setting a public

Councilmamber ~itslar moved and Councilmamber Redapenninq
seconded the motion to accept Resolution No. 93-35.

Councilmsaeber Shirley said that he had attended a Chemical
Health pram forum at the him school. The purpose of the
-- forum ras to discuss Mays to sake a safer place for the kids
going to the prone. 8e said it eras very informative and a
useful tool for the students.

seconded the motion to adjourn. The meeting adjourned by
unanimous consent.
