A Council worlcseasion was held on October 12,1993 is the Raspberry Room at Hopkins City
Ha11.
In attendance was Mayor R~edepenni~g, and Caunoilroembers, Hesch, Krit~ler, Maxwell and
Anderson. Also in attendance were st~membaa,ll~iellee, Cassels and consulting attoiaays Jon
Soon and Dick No~vvn of Doherty, R~m~ble and Butler..

L D~3CQS310N AND UPDATE OF LANDFILL L4SUES
City Manager Steve M~dke reviewed the history of the Tth Stn:,t Landfill site indicetigg that the
landfill had been open and actively used for re6use ~,~+ between 1964 and 1980. The landgII
was closed in 1980. The landfill arcs then monitored with land611 gas m~ituua. In 1988, the City
and the State of 1Vfinnesota anctered into a Cleosut+e Order by Consent which required the City to
test the landfill far methane gas snd ground water pollution problems.
A~~onel wills were installed and it was dF..t~.~.~ined that landfill g~ss at the property line was
above State limns and the City proposed the . 'on of a barrier system to pr+eveat gas fi~om
_-._ toward the Wastbrooke Patio Homes. 3peaal legislation was also received which
alloarod for a loan/grant to the City to help in paying for the remediation project.
Council was iadoa~ed that the PCA was wtreatly aaligg ~ two reports fr~onz the City. One
indicating our :.a~.nu~ns on drt~~..:..~.ys the problems with the hamlet and to ~ hose
problans end the sa~ond was with regard to repayment of the loan/grant.
Jan Soon discussed the cunaat thoughts and efforts with regard to the landfill gas remediati~on in
wl~oich a "po~thalin~g" of the barrier arould be ~*te~ted to determine if their sre breaks in tl~e top
ofthe barrier. He alsomdicatedthat the insurance oona~miea who wa~e insuring the City were
denying any respans~ility for payment of damages and that the City arould likely be firced to sues
poteatislly responsible parties in order to assist in repaying the State foot the loan//grant.
