09-04-90A regular meeting of the Hopkins City Council was held on September ~4, 1990 in the Council Chambers of<Hopkins City Hall. Present were Mayor Berg, Councilmembers Anderson, Shirley, Kritzler and Redepenning. Also present were City staff Mielke, Harmening, Thiel, Gessele, Kerrigan, K. Max, and City Attorney Jerre Miller. I · CALL TO ORDER Mayor Berg call the meeting to order at 7:55 p.m. II. PRESENTATION David Williams of the Hopkins Jaycee's presented the Council with a check for $40,000 for the Ice Arena and another check for $41,000 towards the purchase of the Ice machine. Mayor Berg and entire Council thanked Mr. Williams and the Hopkins Jaycee's on behalf of the entire. City of Hopkins. III. PROCLAMATION (a) Mayor Berg proclaimed the week of September 17 through 23 as Constitution Week in the City of Hopkins. Councilmember Anderson moved and Counci~member Shirley seconded the motion to approve the Proclamation. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye· The motion carried unanimously. (b) Mayor Berg proclaimed September 30, 1990 as June Lundgren Day. Ms. Lundgren has worked for Taits Super-Valu since September 1941 and will be retiring on the 5th of September. Councilmember Anderson moved and Councilmember Redepenning seconded the motion to approve the Proclamation. The motion carried unanimously. IV. PUBLIC HEARING (a) SPECIAL ASSESSMENTS Staff recommended the following motion: Move that Resolution No. 90-98, for the assessment rolls be adopted This action would cause the assessments to be levied against the properties involved. The proposed special assessments are assessments for the project completed to date and their costs. After discussion Mayor Berg opened the Public Hearing at 8:17 p.m. Duane Henke - 411 Hazel Lane stated that he does not feel that the assessment is correct and feels that the'assessment should be made on a per lot basis. Max Otto of 210 'Farmdale Road also stated that the assessment should be based on lot size. Jim Campbell of 355 Sweetebriar Lane supported the staff and feels that a desirable compromise had been reached. September 3, 1990 Page 3 Andre LaTondresse of 112 Farmdale Road felt that a more equitable percentage would be in order. Several more people commented and on the pro's and con's of the assessment ratio. Councilmember Redepenning moved and Councilmember Kritzler seconded the motion to close the public hearing at 9:05 A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye; The motion carried unanimously. 1. Resolution No. 90-98 - Adoption of the assessment roll. project No. 88-07 - Hobby Acres. After further discussion Councilmember Redepenning moved and Councilmember Kritzler seconded the motion to continue the Public Hearing until September 18th. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. The motion carried unanimously. 2. Resolution No. 90-99 Adoption of the Assessment roll project 89-05 Alley Improvement. Staff recommended the following motion% Move that Resolution No. 90-99 for the assessment rolls be adopted. After a brief discussion Mayor Berg opened 'the Public Hearing at 9:35 p.m. Hearing no comments Councilmember Redepenning moved and Councilmember Anderson seconded the motion to close the hearing at 9:36 p.m. A poll of the vote was as follows: Councilmember Anderson, Aye;. Staff recommended adoption of Resolution No. 90-100 for the assessment rolls be adopted. Mayor Berg opened the Public Hearing at 9:37 p.m. Hearing no comments Councilmember Redepenning moved and Councilmember Kritzler seconded the motion to close the Public Hearing at 9:38 p.m. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. Resolution No.. 90-101 Adoption of assessments of miscellaneous proj ects/delinquent utility bills and invoices. Staff recommended that Resoslution No. 90-101 for assessments of miscellaneous projects/deliquent utility bills and invoicesd be adopted. Jim Gessele explained that this item should be looked at due to a Senior Citizen hardship case and that some of the listed items had been paid. Mayor Berg ope'ned the public hearing at 9:40 p.m. Hearing no comments from the audience Councilmember Redepenning moved and Councilmember Anderson seconded the motion to close the public hearing at 9:43 P.M. The motion carried unanimously. (B) RENEWAL OF C.U.P. FOR W. PITT ROLFE Tom Harmening informed Council that Mr. Rolfe's CUP renewal would expire on September 5, 1990 and Mr. Rolfe is requesting a continuation of the CUP for an additional year. Councilmember Anderson moved and Councilmember Shirley seconded the motion to renew the CUP for Mr. Rolfe until September 3, 1991. NEW BUSINESS (a) · CONSIDER ACTION - CONDITIONAL USE PERMIT 125 MONROE AVENUE SOUTH ~ Staff recommended approval of the following motion: Move to adopt Resolution No. 90-88 approving the Conditional Use Permit to allow construction of a new school structure at 125 Monroe Avenue South. Tim Murnane of the Todd Development Company was present to answer questions. He also brought along plans and materials being planned for the building. After discussion Councilmember Shirley moved and Councilmember Redepenning seconded the motion to adopt Resolution No. 90-88 with the Additional following condition: The facility shall be used consistent with that allowed for schools by the Hopkins Zoning Ordinance. Any change in use shall require review and approval by the city of Hopkins. (b) CONSIDER ACTION - WAIVER OF PLAT - HARLEY HOPKINS Staff recommended approval of the following motion: Approve Resolution No. 90-89 making Findings of Fact and approving the Waiver of Plat at 125 Monroe Avenue South and Resolution 90-97 dividing the property into two parcels. After discussion councilmember Anderson moved and Councilmember Shirley seconded the motion to approve Resolution No. 90-89 and Resolution No. 90-97. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. The motion carried unanimously. (c) CONSIDER ACTION - BINGO IN HOPKINS At the City Council workshop on August 14th the City Council discussed bingo as a primary use in Hopkins. The Council discussion focused on the image of bingo, bingo as an accessory use vs primary use, and allowing bingo as a primary use in the B-2 district. The moratorium on the use of Bingo as a primary use expires on September 4. The Council will have to make a decision to either extend the moratorium or to let the moratorium expire. After discussion Councilmember Shirley moved and Councilmember Kritzler seconded the motion to remove bingo as a primary use anywhere in the City and to direct staff to write an ordinance to that effect. A poll of the vote was as follows: Councilmember Anderson, Abstain; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Nay. The motion carried. Councilmember Redepenning moved and Councilmember Kritzler seconded the motion to adopt Resolution No. 90-103 extending the moratorium until December 31, 1990. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye. September 4, 1990 Page 7 (d) CONSIDER ACTION - PETITION FOR ALLEY VACATION BLOCK 200 Staff recommended the following motion: Move that cOuncil deny a petition to vacate portions of an alley in the 200 block between 13th and 14th Avenue North .north of the Chicago Northwestern Railway right-of-way. Councilmember Shirley moved and Councilmember Anderson seconded the motion to deny the petition to vacate portions of an alley in the 200 block between 13th and 14th Avenue North. (e) CONSIDER ACTION - ENGINEERS REPORT - FELTL COURT Staff recommended that the City Council deny the request for "No Parking" signs at the entrance to St. Therese off Feltl Court. After checking the entrance to St. Therese during the months of June through August, their have been no significant changes were noted from the previous study. After discussion Councilmember Kritzler moved and Councilmember Redepenning seconded the motion to deny the request for "No Parking" signs at the entrance to St. Therese of Hopkins. (f) CONSIDER ACTION - EXTENSION TO CURBSIDE RECYCLING CONTRACT Staff recommended adoption of the following motion: Approve a contract extension through June 30, 1993 for curbside recycling, in residential areas, to Waste Management for $2.30 per month per certified dwelling unit for weekly collection. September 4, 1990 Page 8 Jon Thiel and Kathy Max were both present to answer questions regarding the contract extension. After discussion Councilmember Shirley moved and Councilmember Anderson seconded the motion to approve the 'recycling extension through June 30, 1993 with Waste Management. A poll of the vote was as follows: Councilmember Anderson, Aye; Councilmember Shirley, Aye; Councilmember Kritzler, Aye; Councilmember Redepenning, Aye; Mayor Berg, Aye.
