Mr. Kerrigan further stated that in proceeding with eminent domain, the developer would need to provide payment to the city in an amount equal to the estimated total acquisition price and relocation costs. Dan Wilson of Wilson Development Services stated that once eminent domain is instigated, the residents of Pazk Plaza would be eligible for relocation payments. Mr. Wilson also outlined various timing issues as relate to relocation. Mr. Kerrigan stated that there aze presently court cases at both the federal and state levels dealing with eminent domain. He stated that the outcome of these cases could impact the city's ability to use the eminent domain process. Bob Deike of Bradley &Deike discussed legal challenges of eminent domain.
