02-15-05A regular meeting of the Hopkins City Council was held on February 15, 2005, in
the Council Chambers of the Hopkins City Hall.
Present were Mayor Maxwell and Council Members Brausen, Thompson, Johnson
and Rowan. Also, present were staff members Getschow, Genellie, Stadler,
Kerrigan, Harkess, and City Attorney Jerry Steiner.
I. CALL TO ORDER
Mayor Maxwell called the meeting to order at 8:35 p.m.
II. OPEN AGENDA -PUBLIC COMMENTS AND CONCERNS
Senator Steve Kelley appeared before the City Council. He talked briefly about the
current legislative session. The state budget will be the central issue. The City
Council asked questions about various issues of interest to cities. In response to
questions, Senator Kelley said that levy limits would be brought up but that he
opposes them; a gas tax will be proposed but will be difficult to get by the
Governor; the state smoking ban will likely pass; and agreement on expanding
gambling will be difficult.
III. REPORTS -COMMITTEES/COMMISSIONS
1. Chemical Health Commission
Bert Schmidt reported on the last meeting. Michael Borowiak talked to the
Commission about drug use among teens and Reduce the Use.
IV. PRESENTATION
2. VFW Presentation to the Fire Department
Dwayne Best, Post Commander, and Larry Kallin of the Hopkins VFW presented a
"Rabbit" tool to the Hopkins Fire Department. Chief Don Beckering explained that
the "Rabbit" tool allows entry into buildings with minimal damage to the buildings.

Council Member Brausen moved and Council Member Thompson seconded a
motion to approve the Consent Agenda. A poll of the vote was as follows: Council

aye; Council Member Johnson. aye; Mayor Maxwell, aye. The motion carried
unanimously.
VI. PUBLIC HEARING
1. 2005 CDBG Program (CR2005-023)
Kersten Elverum explained the program. As a participating city in the Urban
Hennepin County CDBG program, Hopkins is eligible to receive $119,911 for the
2005 program year. This is a 525,000 reduction from the 2004 allocation. The
funds will be received on July 1, 2005 and must be expended by December 31,
2006. The City must hold a public hearing on the proposed use of the funds. The
City's proposal must be submitted to Hennepin County by March 1, 2005. Staff
recommended that the City fund the Housing Rehabilitation Loan/Grant Program
and the Hopkins Minnetonka Family Resource Center.
The public hearing was opened at 9:04 p.m.
Nora Davis, Hopkins-Minnetonka Family Resource Center, came forward to briefly
explain their services and to thank the Council for its support. Shirley Bilietl?-, ICA
staff member, explained their request. Their housing project helps keep people in
their homes. Last year 55% of the funding went to families in Hopkins.
Council Member Thompson moved and Council Member Johnson seconded a
motion to close the public hearing. The public hearing was closed by unanimous
consent at 9:11 p.m.
Council Member Brausen said that he was very sympathetic to ICA's request and
that he would like to discuss this funding later this year.
Council Member Brausen moved and Council Member Rowan seconded a motion to
adopt resolution 2005-016, approving the proposed program for the 2005 Urban
Hennepin County Community Development Block Grant (CDBG) Program and
authorizing its submittal to Hennepin County. A poll of the vote was as follows:
Council Member Brausen, aye; Council Member Thompson, aye; Council Member
Rowan, aye; Council Member Johnson, aye; Mayor Maxwell, aye. The motion
carried unanimously.
VII. NEW BUSINESS
1. Miscellaneous Fee Increases (CR2005-023)
Animal boarding fees will be removed from the fee schedule. The fee will be
determined by the actual charges of the pound or boarding facility. The license fee
for Truth in Housing evaluators will increase 55.00 to 535.00. A fee for Motor

Vehicle Brokers/Wholesalers/Auctioneers of $50.00 will be established as will a
Rental Housing Re-inspection fee. The Re-inspection fee would not be charged for
the first re-inspection. It would be applied to the second re-inspection and to those
who did not show for an appointment time. A fee is being established for standard
colored CAD plots. A fee for custom CAD Plots is also being added. The fee will be
equal to actual costs of time and materials. Citations issued for failing to obtain a
truth in housing evaluation will be increased from $100 to $200.
Council Member Rowan thought that the re-inspection fee should more accurately
be called a fine since it is imposed upon an owner for failing to perform.
Council Member Brausen asked whether the Inspections' Department charges for
inspections that are done as part of the Truth-in-Housing process. Mr. Genellie said
that he would check.
Council Member Thompson and Mayor Maxwell had questions regarding motor
vehicle brokers including whether they have been licensed in the past and whether
they are restricted on where they can conduct their business. Mr. Genellie said that
he would get them more information.
Council Member Thompson moved and Council Member Brausen seconded a
motion to adopt Ordinance 2005-942, Ordinance Amending Section 355.15,
Administrative Citation Fine Schedule, and Section 925.49 of the Hopkins City
Code for first reading and to adopt Resolution 2005-017, Resolution Setting
Various Fees in Section 1010 and 1020 of the Hopkins City Code. A poll of the
vote was as follows: Council Member Brausen, aye; Council Member Thompson,
aye; Council Member Rowan, Nay; Council Member Johnson, aye; Mayor Maxwell,
aye. The motion carried
2. Fourth Quarter Financial Report
Finance Director Christine Harkess gave the report.
VIII. ADJOURNMENT
There being no further business, Council Member Johnson moved and Council
Member Rowan seconded a motion to adjourn the meeting. The meeting was
adjourned by unanimous consent at 9:53 p.m.
