2018-058 Resolution Approving Preliminary Plat of Sanctuary at Oak Ridge CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 2018-058 A RESOLUTION APPROVING PRELIMINARY PLAT OF SANCTUARY AT OAK RIDGE WHEREAS, on April 27, 2018, Anderson Engineering of Minnesota, LLC, on behalf of Airborne Construction One, LLC (collectively, the "Applicant"), made application for the preliminary plat of Sanctuary at Oak Ridge; and WHEREAS, the subject property is legally described as Lot 2, Block 1; and Outlots A & B, all in Oak Ridge Place 2nd Addition, Hennepin County, Minnesota; and WHEREAS, on May 22, 2018, the Hopkins Planning & Zoning Commission, pursuant to proper notice, held a public hearing on the application and following said public hearing recommended approval of the application; and WHEREAS, on June 18, 2018, the City Council considered the application and its corresponding staff report at a public meeting; and WHEREAS,based upon said hearing, staff report,and recommendations,the City Council hereby finds that the preliminary plat for Sanctuary at Oak Ridge meets the requirements of the Hopkins City Code and further finds that approval of the preliminary plat,subject to the conditions outlined below, is warranted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins as follows: 1. The recitals set forth above are incorporated into this Resolution as if fully set forth herein. 2. That the preliminary plat for Sanctuary at Oak Ridge is hereby approved, subject to the following conditions: a. Approval of the requisite Comprehensive Plan amendment of the subject property to low density residential by the City of Hopkins and the Metropolitan Council. b. Approval of the rezoning of the subject property to R-1-D, Single Family Low Density PUD by the City of Hopkins. c. The Applicant shall enter into a development agreement with the City and execute a planned unit development agreement, which shall both be in a form and of substance acceptable to the City, and all requirements contained in said development agreement shall be satisfied. 1 d. The Applicant shall address and conform to all conditions and requirements of the City Engineer, including, but not limited to, those provided in the June 18, 2018 staff report. e. The Applicant shall address and conform to all requirements of the Minnehaha Creek Watershed District, including, but not limited to, the requisite wetland approvals and delineations summarized in the June 18, 2018 staff report. f. The Applicant shall submit current title work for the plat and shall conform to any requirements resulting from City staff and the City Attorney's review of the title work and plat opinion. g. The Applicant shall form a homeowner's association to manage and maintain shared amenities and common areas, including the requisite shared access, in a form satisfactory to both City staff and the City Attorney. h. The Applicant shall pay to the City all applicable fees and expenses incurred by the City as related to the development. i. Except as otherwise expressly authorized by City resolution or ordinance, all aspects of the development shall comply with all applicable state laws, city codes, ordinance, and regulations. 3. The City Council authorizes City staff and City consultants to take any appropriate action necessary and convenient in order to accomplish the intent of this Resolution, and to prepare any appropriate documents to facilitate the directives of the City Council as set forth in this Resolution.
