05-20-2008A regular meeting of the Hopkins City Council was held on May 20, 2008, in the Council
Chambers of the Hopkins City Hall.
Present were Mayor Maxwell and Council Members Brausen, Youakim, Rowan, and
Halverson. Also, present were staff members Getschow, Genellie, Stadler, Elverum,
Bradford, and City Attorney Jerry Steiner.
I. CALL TO ORDER
Mayor Maxwell called the meeting to order at 7:30 p.m.

III. CONSENT AGENDA

Council Member Halverson moved and Council Member Brausen seconded a motion to
approve the Consent Agenda. A poll of the vote was as follows: Council Member
Youakim, aye; Council Member Brausen, aye; Council Member Rowan, aye; Council
Member Halverson, aye; Mayor Maxwell, aye. The motion carried unanimously.
IV. NEW BUSINESS
1. Accept Bids, Declare Cost to be Assessed and Order Assessment Hearing for
2008 Street and Utility Improvement Project (CR2008-051)
The bid opening for the 2008 Street and Utility Improvement Project was held on May
13, 2008. Eight bids were submitted with the lowest bid of $1,033,733.83 being
submitted by Valley Paving. The amount was $289,000 less than the engineer's
estimate. The total amount to be assessed is $232,404.23. Assessments would be
financed for ten years at 7 % interest. One homeowner will be doing water replacement
at a cost of$535. The assessment hearing would be set for June 17t", 2008.

The asphalt trail on the south side has been changed to a cement sidewalk. The sidewalk
will extend to the park and then tie into the trail. Driveways will be finished with
concrete aprons. The sidewalk on the north side will be constructed in such a way to
preserve all large oak trees.
Council Member Rowan moved and Council Member Halverson seconded a motion to
adopt Resolution 1008-033, Accepting Bid for 2008 Street and Utility Improvement
Project. A poll of the vote was as follows: Council Member Youakim, aye; Council
Member Brausen, aye; Council Member Rowan, aye; Council Member Halverson, aye;
Mayor Maxwell, aye. The motion carried unanimously.
Council Member Youakim moved and Council Member Brausen seconded a motion to
adopt Resolution 2008-034, Declaring Cost to be Assessed, and Ordering Preparation of
Proposed Assessment. A poll of the vote was as follows: Council Member Youakim,
aye; Council Member Brausen, aye; Council Member Rowan, aye; Council Member
Halverson, aye; Mayor Maxwell, aye. The motion carried unanimously.
Council Member Halverson moved and Council Member Brausen seconded a motion to
adopt Resolution 2008-035, Resolution for Hearing on Proposed Assessments, 2008
Street and Utility Improvements, City Project 07-10. A poll of the vote was as follows:
Council Member Youakim, aye; Council Member Brausen, aye; Council Member Rowan,
aye; Council Member Halverson, aye; Mayor Maxwell, aye. The motion carried
unanimously.
2. First Reading: Ordinance Amending City Code Section 830, Parks, Recreational
and Open Spaces (CR2008-049)
The City Council and the Park Board initially discussed a policy change allowing leashed
dogs in parks at the joint meeting held in January 2008. At the March 1 7, 2008 Park
Board Meeting, the Board approved a recommendation to change City policy to allow
leashed dogs in four of the largest City parks; Burnes, Oakes, Valley and Central. The
change to Section 830 would allow leashed dogs along the park trails and open areas
only. Leashed dogs would not be allowed in picnic areas, athletic fields, play equipment
areas, park buildings, or surfaced recreational areas. Public works will change signage
and install baggies in the parks before the ordinance becomes effective. In answer to
Council Member Rowan's questions about the inclusion of "or other domestic animals",
Jerry Steiner, City Attorney, said that he would review the ordinance before second
reading.
The change will be reviewed after one year to see if it is working.
Council Member Brausen moved and Council Member Rowan seconded a motion to adopt
for first reading Ordinance 2008-1001, amending City Code Section 830. A poll of the
vote was as follows: Council Member Youakim, aye; Council Member Brausen, aye;

motion carried unanimously.
Mayor Maxwell reminded everyone to attend the review of the Comprehensive Plan at the
Hopkins Center for the Arts on Wednesday, May 21 from 5:00 p.m. to 7:00 p.m.
VIII. ADJOURNMENT
There being no further business, Council Member Brausen moved and Council Member
Youakim seconded a motion to adjourn the meeting. The meeting was adjourned by
unanimous consent at 7:56 p.m.
