1999-026CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 99-26 RESOLUTION MAKING FINDINGS OF FACT APPROVING A SETBACK VARIANCE AT 1714 MAINSTREET WHEREAS, an application for Variance VN99-1 has been made by Carl Hanson; WHEREAS, the procedural history of the application is as follows: 1. That an application for a setback variance was made by Carl Hanson on March 5, 1999; 2. That the Hopkins Zoning and Planning Commission, pursuant to mailed notice, held a meeting on the application and reviewed such application on March 30, 1999: all persons present were given an opportunity to be heard; That the written comments and analysis of City staff were considered; and 4. The legal description of the property is as follows: The north 102 feet of Lots 3 and 4. The north 102 feet of Lot 5 except the east 2 feet of said Lot 5: all in Block 2, in "Boulevard Manor Addition", according to the plat thereof on file of record in the office of the Registrar of Titles in and for said County, Hennepin County, Minnesota. NOW, THEREFORE, BE IT RESOLVED that the application for Variance VN99-1 is hereby approved based on the following Findings of Fact: 1. That the rear yard setback of 15 feet of applicant's lot abuts a side yard of an adjacent property with a zero setback. 2. That the unusual configuration of four adjacent lots without separation of alleys or street substantially diminish the planning purpose of setbacks and create a hardship for building improvements not contemplated or intended in the enforcement of the applicable ordinance setback requirements. 3. That the existing structure on the lot adjacent to the rear of the applicant's property is within one foot of the lot line.
