1995-023 r:, o o o CITY OF HOPKINS H nn pin county, Hinn sota RESOLUTION 95-23 RESOLUTION REAFFIRMING THE COOPERATIVE RELATIONSHIP BETWEEN NINE MILE CREEK WATERSHED DISTRICT AND THE CITY OF HOPKINS WHEREAS, the City of Hopkins is within the Nile Mile Creek Watershed District and is preparing and implementing a local water management plan pursuant to the Watershed Management Plan of Nine Mile Creek Watershed District, and WHEREAS, the Nine Mile Creek Watershed District, in cooperation with the City, has completed millions of dollars of watershed improvements, including box culvert and flood management improvements and creek bed maintenance improvements on Nile Mile Creek, and WHEREAS, such projects were initiated by a petition of the city of Hopkins within the Nine Mile Creek Watershed District and will be financed through Minn. Stat. 103D.905,Subd. 3, and WHEREAS, the Board of Water and Soil Resources is recommending that Nine Mile Creek Watershed District finance projects using Minn. Stat. 103B.241, Subd.1, which does not require a municipal petition, as opposed to continued use of the Watershed Act, Chapter 103D, and WHEREAS, the City of Hopkins does not want its involvement in project and financing decisions altered, NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA: 1. The City urges the Board of Water and Soil Resources to continue to support use of the Watershed Act, Chapter 103D, for the purpose of financing projects or improvements within the Nine Mile Creek Watershed District and to abandon mandating use of Minn.Stat. 103B.241, Subd.l. 2. The Council of the City of Hopkins supports the intention of the Board of Water and Soil Resources to allow for adoption by reference of guidelines or best management practices previously published by state agencies or departments and opposes the promulgation by the Nine Mile Creek Watershed District of unique, free standing rules and ordinances more restrictive than state statutes or rules governing water resources. o 3. The City Clerk shall transmit copies of this resolution to the Chair of the Board of Water and Soil Resources, the Mayor and Council of the several cities within the watershed district, the Board of Managers of Nine Mile Creek Watershed District and the Board of commissioners of Hennepin County, as well as other executive and legislative officials.
