RESOLUTION NO: 95-32
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SIDE YARD VARIANCE
TO CONSTRUCT RAPID OIL CHANGE
WHEREAS, an application for Conditional Use Permit VN95-1 made by Valvo line Instant Oil
Change to construct a new Rapid Oil Change building at 1124 East Excelsior Avenue is approved.
WHEREAS, the procedural history of the application is as follows.
1. That an application for Variance VN95-1 was filed with the City of Hopkins on March
27, 1995.
2. That the Hopkins Planning Commission, pursuant to mailed. notices, held a meeting on the
application and reviewed such application on April 25, 1995.
3.
That the written comments and analysis of the City Staff and the Planning Commission
were considered.
4. A legal description of the subject property is as follows.
That part of the Northwest Quarter of the Southeast Quarter of Section 19, Township
117, Range 21, Hennepin County, Minnesota described as follows: Beginning at the
intersection a line drawn parallel with and 33 feet west of the east line of said Northwest
Quarter of the Southeast Quarter with the southerly line of Excelsior Boulevard as
originally located; thence southwesterly along said southerly line 150.00 feet; thence
southeasterly at right angles 100.00 feet; thence northeasterly at right angles 123.8 feet to
a line drawn parallel with said east line form the point of beginning; thence north along
said parallel line 103.37 feet to the point of beginning.
NOW THEREFORE, BE IT RESOL YED that the application for Variance VN95-1 is hereby
approved based onthe following Findings of Fact.

That the reconstruction of County Road 3 will require 30 feet of the applicants
property.

That the 30 feet of right-of-way to be taken creates a unique hardship for the
applicants property.
That the granting variance provides a buildable site for the applicant with the
additional right-of-way for County Road 3.
