1994-062 _ It ~_, CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 94-62 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING CONDITIONAL USE PERMIT FOR KATHERINE CURREN SCHOOL AT 1600 MAINSTREET WHEREAS, an application for a conditional use permit, CUP94-1, made by Independent School District #270 for additions, remodeling and site work at Katherine Curren School, 1600 Mainstreet. WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit CUP94-1 was filed with the City of Hopkins on June 3, 1994. 2. That the Hopkins Planning Commission, pursuant to mailed notices, held a public hearing on the application and reviewed such application on June 28, 1994: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of the City staff and the Planning Commission were considered. 4. A legal description of the subject property is as follows: Par 1: All that part of the Southwest Quarter of the Southwest Quarter of section 24, Township 117 North, Range 22 West, described as commencing at a point in the South line of Excelsior Road where said South line of said road is intersected by the center line produced Southward of sixteenth Avenue as said avenue is laid out in the plat of Gibbs First Addition to West Minneapolis; thence Southerly along the extended center line of Sixteenth Avenue produced Southerly 608.27 feet; thence Westerly to a point in the West line of said Southwest Quarter of said section 24, 608.12 feet South measured along the said West line from the intersection of said West line with the Southerly line of said Excelsior Avenue, as said Excelsior Avenue is laid out Easterly and Westerly across said section; thence Northerly along the said West line to the South line of Excelsior Avenue; thence Easterly along the said South line of Excelsior Avenue to the beginning. Subject to a reservation by the County of Hennepin of all iron ore and other valuable minerals in and upon said premises, with the right to explore for, mine and remove the same as created by deed of record in Book 1733 of Deeds, page 301, in the office of the Register of Deeds of said Hennepin County; Subject to an easement in favor of the County of Hennepin, its successors, lessees or assigns, to use the South 150 feet of said ,premises as a motor vehicle parking place for public use during such times as the property known RESOLUTION NO: 94-62 Page 2 as the Hennepin County Fairgrounds in Hopkins, Minnesota, may be used for conducting the Hennepin County Fair or for conducting thereon any other exhibitions or attractions which may invite public attention at the Hennepin County Fairgrounds; also sUbject to the charge that prior to August 1, 1949, Independent School District Number Nineteen, Hennepin County, Minnesota, will surface said portion of the premises with bituminous material so as to fit it adequately for said use; Par 2: All that part of the Southwest Quarter of the Southwest Quarter of section 24, Township 117, North of Range 22 West, bounded and described as follows, to-wit: Commencing at a point in the South line of Excelsior Road where the said South line of said Excelsior Road is intersected by the center line produced Southward of 16th Avenue as platted in the plat of Gibbs First Addition to West Minneapolis, Hennepin County, Minnesota, thence Southerly along the extension of said center line of 16th Avenue produced Southerly a distance of 638.27 feet; thence Easterly on a line parallel with said South line of Excelsior Road 331.2 feet, more or less, to the intersection of said line with the extension of the center line of 15th Avenue as platted in said Gibbs First Addition and as platted in West Minneapolis Second Division produced in a straight line southward; thence Northerly along said center line of 15th Avenue extended as aforesaid, a distance of 638.27 feet to the South line of said Excelsior Road; thence West along the South line of said Excelsior Road 329.2 feet, more or less, to the point of beginning, except that part thereof which lies northerly of a line and its extensions, drawn from a point on the westerly line of said above described property, distant 248.00 feet southerly from the northwest corner of said above described property, to a point on the easterly line of said above described property distant 272.00 feet southerly from the northeast corner of said above described property, and west of the east 30.00 feet thereof. NOW THEREFORE, BE IT RESOLVED that the application for conditional use permit CUP94-1 is hereby approved based on the following Findings of Fact: 1. That the proposed additions meet the requirements for a school in a residential zoning district. BE IT FURTHER RESOLVED, that application for CUP94-1 is hereby approved based on the following conditions: 1. That a lighting plan is submitted by the applicant and approved by the City staff. 2. That the "Park" sign on 17th Avenue is to remain. 3. That the drive opening into the public works area as shown on the site plan is modified and approved by the staff. RESOLUTION NO: 94-62 Page 3 4. That the entire lot is seal coated with FA3 after all patching is completed. 5. That the City and the School District enter into an agreement regarding the maintenance, legal and liability issues with regard to the use of the parking lot. Adopted this 5th day of July, 1994.
