1994-751 CITY OF HOPKINS COUNTY OF HENNEPIN ORDINANCE NO. 94-751 AN ORDINANCE AMENDING SECTION 930 OF THE HOPKINS CITY CODE ALARM SYSTEMS The C~ty Council of the C~ty of Hopk~ns does hereby orda~n: SECTION 1. That Sect~on 930.03, Subd~v~s~on 2 be amended to read as follows: Subd. 2. "Alarm" means a :HnEjle transrruss~on from any alarm ~nstallat~on wh~ch summons pol~ce, f~re, or med~cal personnel. SECTION 2. That Sect~on 930.03, Subd~v~sion 4 be amended to read as follows: Subd. 4. "Alarm ~nstallat~on" or "alarm system" means any mechan~cal, electr~cal, or electron~c dev~ce wh~ch d~rectly or ~nd~rectly summons ~ pol~ce, f~re or med~cal personnel dcpartment of the c~ty. SECTION 3. That Sect~on 930.03, Subd~v~s~on 5 be amended to read as follows: Subd. 5. "Alarm user" means thc person ~n centrel ef any any person, owner, occupant, tenant, f~rm, partnersh~p, associat~on, corporation, company, or organ~zat~on of any k~nd upon whose prem~ses, bu~ld~ng, structure, or fac~l~ty %ft wftreft an alarm ~nstallat~en system ~s ma~nta~ned. SECTION 4. That Sect~on 930.03, Subd~v~s~on 7 be amended to read as follows: Subd. 7. "Automat~c d~al~ng dev~ce" means a dev~ce wh~ch ~s ~nterconnected w~th a telephone l~ne and ~s des~gned or programmed to select a predetermined telephone number and transm~t by vo~ce message or code s~gnal an emergency message ~nd~cat~ng the need for emergency pol~ce, f~re, or med~cal department serv~ces. Subd. 8. "False Alarm" means an alarm message or transmitted e~ther automat~cally or manually through an alarm response by pol~ce, f~re or med~cal personnel when no act~v~ty, med~cal or other emergency ex~sts. s~gnal ~n~t~ated and system wh~ch summons a f~re, smoke, cr~m~nal "False Alarm" shall also mean the fa~lure or refusal of an alarm user or author~zed des~gnee to respond upon request to the activated alarm system locat~on to ass~st pol~ce/f~re personnel, whether or not an emergency ex~sts. "False Alarm" DOES NOT ~nclude an alarm caused by v~olent condit~ons of nature, ut~lity l~ne m~shaps, power outages or other unusual c~rcumstances wh~ch are deterrruned to be beyond the control of the alarm system or user. SECTION 6. That Sect~on 930.05, Subd~v~s~on 4 be amended to read as follows: Subd. 4. Exempt~on. Subd~v~s~on 1. For each Pol~ce false alarm ~n excess of four per calendar year (January 1 through December 31), a fee shall be pa~d by the perrrut holder to the C~ty of Hopk~ns. Th~s fee shall be set by C~ty Counc~l resolut~on. Subd. 2. False Alarm B~ll~ng. If a false alarm charge rema~ns unpa~d beyond 60 days, unpa~d fees and late payment penalt~es may be collected by assess~ng the amounts aga~nst the property where the false alarm occurred. SECTION B. That Sect~on 930.09, be added to read as follows: 930.09 Proh~b~ted Acts. Subd~vis~on 1. Automat~c D~al~ng Dev~ces. No person shall use or cause to be used any automat~c d~al~ng dev~ce that automat~cally selects any telephone l~ne to the C~ty, pol~ce, f~re or any of ~ts departments or d~v~s~ons. Subd. 2. Test~ng of Equ~pment. No alarm system des~gnated to summon pol~ce, f~re or medical personnel shall be tested or demonstrated w~thout f~rst notifying the pol~ce department. The unannounced test~ng of equ~pment wh~ch results ~n not~f~cat~on and response by pol~ce, f~re or med~cal personnel shall be ~n v~olat~on of th~s sect~on and des~gnated as a false alarm. Subd. 3. Intent~onal False Alarms. a false alarm or otherw~se, d~rectly or pol~ce, f~re, med~cal personnel. No personal shall ~ntent~onally act~vate ~nd~rectly, cause a false response of SECTION 9. That Sect~on 930.11, be added to read as follows: 930.11 Aud~ble Alarms. Alarm systems w~th aud~ble sounds shall not sound for a per~od exceed~ng 15 rrunutes unless otherw~se author~zed. SECTION 10. The effect~ve date of th~s ord~nance shall be twenty days after publ~cat~on. Adds med~cal personnel to the l~st of emergency serv~ces wh~ch rrught be summoned by an alarm system; 2. Expands the definit~on of an Alarm User; 3. Expands the def~n~t~on of what const~tutes a false alarm; 4. Amends the current language regard~ng false alarm fees to br~ng ~t ~nto conformance w~th current pract~ce; 5. Adds language proh~b~t~ng alarm systems that automat~cally d~als the pol~ce or f~re departments; 6. Adds language proh~b~t~ng the test~ng of alarm systems without not~fy~ng the C~ty; and 7.
