1993-041 ~~ . o o ~ CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 93-41 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A CONDITIONAL USE PERMIT WHEREAS, an application for a conditional use permit CUP 93-9, made by Leo Esget to build a storage lot at 630 Eleventh Avenue South is approved. WHEREAS, the procedural history of the application is as follows: 1. That an application for a conditional use permit CUP 93-4 was filed with the City of Hopkins on March 26, 1993. 2. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a pUblic hearing on the application and reviewed such application on April 27, 1993: all persons present at the hearing were given an opportunity to be heard. 3. That the written comments and analysis of the City staff and the Planning Commission were considered. 4. That the legal description of the property is as follows: Lot 6 and 7, Block 57 West Minneapolis. NOW THEREFORE, BE IT RESOLVED that the application for conditional use permit CUP 93-4 is hereby approved based on the following Findings of Fact: 1. That the applicant's use is permitted in the I-I zoning district with a conditional use permit. 2. That the applicant's proposed use complies with the requirements for a conditional use permit. BE IT FURTHER RESOLVED, that application for CUP 93-4 is hereby approved based on the following conditions: 1. That the fence along 11th Avenue is set back 20 feet from the property line. 2. That the applicant comply with the requirements of 540.03M of the Zoning Ordinance which are the requirements for a storage lot. o ~.. .- RESOLUTION NO: 93-41 Page 2 o 3. That the applicant provide a letter of credit, bond or cashier's check, 1 1/2 times greater than the cost of the landscaping and fencing. This bond, letter of credit or cashier's check shall be valid for two growing seasons. 4. That the fencing must be installed by July 1, 1993. 5. That the landscaping must be installed by August 1, 1993. 6. Any buildings on the site will comply with building codes if applicable. 7. That the building on the site may not be used for office purposes. 8. That the entire lot is surfaced with Class 5 with the applicant to provide dust control measures on an ongoing basis as dictated by the City Engineer. 9. That the fence along the east, north, and south sides of the site is a 6 foot wood fence. 10. That the applicant get approval from the watershed c:> district, if approval is required. 11. That the alley behind the applicant's property is hard surfaced pursuant to a plan approved by the city Engineer. 12. That any storage of materials in the lot is covered. 13. That materials stored in the lot are not stacked or piled higher than 6 feet. 14. That the applicant provide a grading plan for the site. Furthermore, when the lot is graded, dust control measures are to be used to control the dust. Adopted by the city Council of the City of Hopkins May, 1993. ATTEST:
