1993-137 ..~ '., o o o ~ .< CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 93-137 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A WAIVER OF PLAT AT 234 - 18TH AVENUE NORTH WHEREAS, Phil Hines has applied to the City Council of Hopkins for approval of a division of PID 23-117-22-14-0094, PID 23-117~22-14-0095 and PID 23-117-22-14-0096 lying within the North 1/2 of section 23 County of Hennepin, State of Minnesota. A legal description of the subject property is as follows: Parcel 1 Lot 6 and the north 4.05 feet of Lot 7, Block 7, West Minneapolis Third Addition. Parcel 2 The north 2.00 feet of Lot 8 and that part of Lot 7 lying south of the north 4.05 feet thereof, all in Block 7, West Minneapolis Third Addition, according to the plat thereof on file and of record in the office of the County Recorder in and for Hennepin County, Minnesota. Parcel 3 That part of Lot 8, Block 7, West Minneapolis Third Addition lying south of the north 2.00 feet thereof, according to the plat thereof on file and of record in the office of the County Recorder in and for Hennepin County, Minnesota. WHEREAS, the procedural history of the application is as follows: 1. That an application for a waiver of plat WVR93-1 was filed with the City of Hopkins on November 15, 1993. 2. That the Hopkins Planning Commission, pursuant to mailed notices, held a meeting on the application and reviewed such application on November 30, 1993: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of the city staff and the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED that the application for waiver of plat WVR93~1 is hereby approved based on the following Findings of Fact: ~ 'Ill ~ RESOLUTION NO: 93-137 Page 2 o 1. That the proposed lots meet the requirements of the R-1-A zoning district. BE IT FURTHER RESOLVED, that application for WVR93-1 is hereby approved based on the following conditions: 1. That Parcel 2 & 3 are combined as one tax parcel until the applicant applies for a building permit for those parcels. 2. That the existing home is razed before the certificate of occupancy is granted for the single family home. 3. Applicant obtain any required permits to extend water and sewer into the lots.
