1991-150 .; , o o o CITY OF HOPKINS Hennepin County, Minnesota RESOLUTION NO: 91-150 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR WAIVING THE PLATTING REQUIREMENTS TO DIVIDE THE LOT AT 6 WEBSTER PLACE WHEREAS, an application for a waiver of plat entitled WVR 91-2 made by Bertin Bisbee is approved. WHEREAS, the procedural history of the application is as follows: 1. That an application for waiver of plat WVR 91-2 was filed with the city of Hopkins on October 19, 1991 to divide PID #13 117 22 23 0014. 2. That the Hopkins Planning Commission reviewed such application on November 26, 1991. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a hearing on November 26, 1991: all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City staff and the Planning commission were considered. NOW THEREFORE BE IT RESOLVED, that application for WVR 91-2 is hereby approved subject to the following Findings of Fact: 1. That the new lots meet the minimum lot size requirements for an R-1-E .district. BE IT FURTHER RESOLVED, that application for WVR 91-2 is hereby approved subject to the following Conditions: 1. That when a home is constructed on the vacant lot, it will be required to connect to city sewer and water. 2. That the required fees are paid to connect with the city sewer and water. 3. That the applicant obtain a driveway permit from Hennepin County for a driveway when the home is constructed. 4. That the recommendation of the Park Board for the park dedication ordinance is met. 5. That a drainage easement dedicated to the City will be required up to 100 year flood elevation. NOW THEREFORE, it is hereby resolved by the City Council of the City of Hopkins that said premises as below described are divided as hereinabove set forth without further platting or other formal subdivision requirements. _ 't' RESOLUTION NO: 91-150 Page 2 o PARCEL A That part of Lot 4, Block 7, "Bellgrove," according to the plat therof on file or of record in the office of the Registrar of Titles in and for Hennepin County, Minnesota, which lies northerly of a line described as follows: Beginning at a point on the east line of said Lot 4 distant 140.00 feet southerly from the northeast corner of said Lot 4; thence westerly, to a point on the west line of said Lot 4 distant 140.00 feet southerly from the northwest corner of said Lot 4 and said line there terminating. PARCEL B That part of Lot 4, Block 7, "Bellgrove," according to the plat thereof on file or of record in the office of the Registrar of Titles in and for Hennepin County, Minnesoata, which lies southerly of a ~ine described as follows: Beginning at a point on the east line of said Lot 4 distant 140.00 feet southerly from the northeast corner of said Lot 4; thence westerly, to a point on the west line of said Lot 4 distant 140.00 feet southerly from the northwest corner of said Lot 4 and said line there terminating. o Lot 3, except that part lying Northerly and Easterly of the following described line and its extensions: Beginning at a point in the Southerly line of said Lot 3, distant 120.05 feet Westerly, measured along said Southerly line, from the Southeast corner of said Lot 3; thence North at a right angle to said South line, 18 feet; thence Northwesterly deflecting to the left 31 degrees 00 minutes a distance of 67 feet; thence Northwesterly a distance of 114.9 feet to a point on the West line of said Lot 3 distant 147.3 feet Northerly as measured along said West line, from the Southwest corner of said Lot 3 and there terminating, Block 7, "Bellgrove," according to the plat thereof on file or of record in 'the office of the Registrar of Titles in and for Hennepin County., Adopted this 3rd day of December, ATTEST:
