RESOLUTION NO: 89-82
RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-15
WHEREAS, an application for a Conditional Use Permit
entitled CUP89-15 made by Timothy Lewis, 324 10th
Avenue North, to construct a five foot fence in
the front and side yards is hereby denied.
WHEREAS, the procedural history of the application is as
follows:

1. That an application for Conditional Use
Permit CUP89-15 was filed with the City of
Hopkins on August 28, 1989.
2. That the Hopkins Planning Commission reviewed
such application on September 26, 1989.
3. That the Hopkins Planning Commission,
pursuant to published and mailed notices,
held a public hearing on September 26, 1989:
all persons present at the hearing were given
an opportunity to be heard.
4. That the written comments and analysis of the
City Staff and the Planning commission were
considered.
NOW
THEREFORE BE IT RESOLVED, that application for
Conditional Use Permit CUP89-15 is hereby denied
subject to the following Findings of Fact:
1. That the applicant does not have a special
purpose to justify a 5 foot fence in the
front and side yard.
2. That the granting of the Conditional Use
Permit for the subject fence would set a
precedent for all of Hopkins to have higher
than allowed fences in the front and side
yards.
