RESOLUTION NO: 89-33
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP89-5
WHEREAS, an application for a Conditional Use Permit entitled
CUP89-5 made by The Pemtom Company,
to construct five townhomes on the east side of County
Road 73 just north of Robinwood Lane is approved.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for Conditional Use Permit
CUP89-5 was filed with the City of Hopkins on May
8, 1989.
2. That the Hopkins Planning Commission reviewed such
application on May 30, 1989.
3. That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a public
hearing on May 30, 1989: all persons present at
the hearing were given an opportunity to be heard.
4. That the written comments and analysis of the city
Staff and the Planning Commission were considered.
NOW THEREFORE BE IT RESOLVED, that application for Conditional
Use Permit CUP89-5 is hereby approved subject to the
following Findings of Fact:
1. That townhomes are a permitted use within an R-3
District.
2. That the proposed townhomes meet the requirement
for an R-3 District.
BE IT FURTHER RESOLVED, that application for CUP 89-5 is hereby
approved subject to the following Conditions:
1. That the preliminary plat is approved.
2. That Hennepin County approves the access point into the
site.
3. That all utilities are obtained from Hopkins if
possible.
4. That the walking path on the south side of the property
remains.
5. That the Minnehaha Watershed District approves the
proposed development.
6. That the Traffic Engineer reports to the city Council
on potential traffic problems on County Road #73.
