A regular meeting of the Hopkins City Council was held on
May 3, 1988 in the Council Chamber of Hopkins City Hall.
Present were Mayor Milbert, Councilmembers Anderson,
Shirley, Kritzler, and Redepenning. Also present were City
staff members Rapp, Mielke, Genellie, G. Anderson, E.
Johnson, N. Anderson, Fitsinger and City Attorney Miller.
I . CALL TO ORDER;
Mayor Milbert called the meeting to order at 7:30 p.m.
II. PROCLAMATIONS:
a. Mayor Milbert proclaimed May 18, 1988 as Transit
Appreciation day.
b. Mayor Milbert proclaimed June 14,1988 as Flag Day
in Hopkins.
III. CONSENT AGENDA
1. Approval of the April 19, 1988 Regular Meeting Minutes
2. Approval of Disbursements, prelist #788
3. Approval of Miscellaneous License
4. Approval of State Aid Street Designations
5. Approval designation of Fire Lanes - Greenfield
Apartments
Councilmember Anderson moved and Councilmember Shirley
seconded the motion to approve the Consent Agenda.
A poll of the vote was as follows: Councilmember
Redepenning, Aye; Councilmember Kritzler, Aye; Councilmember
Shirley, Aye; Councilmember Anderson, Aye; Mayor Milbert,
Aye. The motion carried unanimously.
IV. OLD BUSINESS:
a. CONSIDER ACTION - "CRUISING" REPORT"
Chief Earl Johnson appeared before Council to request an
additional six week period to study the current barricade
pattern on Mainstreet. He said the Police Department will
be able to come up with better facts with the warmer weather
and school letting out soon for the summer.

A group of concerned neighbors appeared before Council to
thank them for the relief they have provided with the
additional barricades. They gave the Council and Chief
Johnson a warm thank you. Councilmember Shirley informed
the Council that the idea of the additional barricades had
come from Councilmember Redepenning.
Councilmember Anderson moved and Councilmember Shirley
seconded the motion to continue with current barricades for
an additional six week study.
A poll of the vote was as follows: Councilmember
Redepenning, Aye; Councilmember Kritzler, Aye; Councilmember
Shirley, Aye; Councilmember Anderson, Aye; Mayor Milbert,
Aye. The motion carried unanimously.
b. CONSIDER ACTION - ROOF DRAINAGE REQUEST
Mr. Roof appeared before council to voice his concerns over
the drainage problem with his properties. Gordy Anderson
assured him that the problem is being looked into and the
report will be completed by June 1, 1988.

Councilmember Redepenning moved and Councilmember Kritzler
seconded the motion to Acknowledge concerns of Mr. Roof and
delay action until after completion of the storm water
management study.

c. CONSIDER ACTION - SECOND READING ORDINANCE 88-612
Jim Genellie requested approval for the second reading
changing the current 3.2 beer temporary license from $25.00
per day to $25.00 per event not to exceed three consecutive
days.

seconded the motion to approve the Ordinance 88-6l2 for
second reading and pUblish.

CONSIDER ACTION - REZONING - CORNER 7 AND COUNTY ROAD

A request by Stobbe Development to rezone the parcel at
Cambridge and Van Buren North from R-2 to R-4. Approval of
this ordinance will allow Mr. Stobbe to construct a 63 unit
apartment building.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion that the request by Stobbe Development
to rezone the parcel at Cambridge and Van Buren North from
R-2 to R-4 is approved by Resolution No. 88-10, and Council
approval of Ordinance No. 88-607 for first reading.
A poll of the vote was as follows: Councilmember
Redepenning, Aye; Councilmember Kritzler, Aye; Councilmember
Shirley, Aye; Councilmember Anderson, Aye; Mayor Milbert,
Aye. The motion carried unanimously.
b. CONSIDER ACTION - CONDITIONAL USE PERMIT - STOBBE
CONSTRUCTION 63 UNIT APARTMENT.

Stobbe Construction has reque~ted a Conditional Use Permit
to construct a 63 unit apartment building at Cambridge and
Van Buren Avenue.
Councilmember Redepenninq moved and Counci1member Anderson
seconded the motion to approve Resolution #88-22 approving
the Conditional Use Permit with conditions.
A poll of the vote was as follows: Councilmember
Redepenning, Aye; Councilmember Kritzler, Aye; Councilmember
Shirley, Aye; Councilmember Anderson, Aye; Mayor Milbert,
Aye. The motion carried unanimously.
c. CONSIDER ACTION - CONDITIONAL USE PERMIT - STOBBE
REMOVAL OF SOIL.

Nancy Anderson appeared before Council and stated that the
Zoning and Planning Committee approves the removal of 400
cubic yards of soil. Approval of this motion will allow the
applicant to dig the basement of the proposed 63 unit
apartment building.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion to approve Resolution 88-21 Conditional
Use Permit with conditions.

d. CONSIDER ACTION - VARIANCE - DAN LAPHAM - FRONT YARD
SETBACK
Nancy Anderson stated that staff recommended a 15 foot front
yard variance for construction of a garage to be attached to
Mr. Lapham's house.
Mr. Lapham appeared before Council stating that he has a
handi-capped daughter and needs to put a ramp in the garage
leading into the house. This is why he is requesting the
larger 19 foot variance.
Councilmember Shirley moved and Councilmember Kritz1er
seconded a motion to adopt Resolution #88-29 approving a 19
foot front yard variance, and amending the resolution to
include an additional finding of fact with respect to the
sound barrier on surrounding properties.

e. CONSIDER ACTION - VARIANCE - DALE RUHA - SIDEYARD
SETBACK
Nancy Anderson appeared before Council stating that an
alternative suggestion has been made to Mr. Ruha and he is
quite satisfied with the suggestion.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion to approve Resolution #88-31, denying
the variance request.
A poll of the vote was as follows: Councilmember

f. CONSIDER ACTION - VARIANCE - ROGER JEWETT - SIDEYARD
SETBACK
staff and the Zoning and Planning commission recommended
that this variance be denied. Mr. Jewett appeared before
Council stating that the original ordinance not allowing
this setback has been changed. He also stated that as he is
aging he feels that this is necessary to keep he and his
wife in their home longer. Staff feels that no undue
hardship has been shown.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion to approve Resolution #88-32, denying
the variance request.
A poll of the vote was as follows: Councilmember
Redepenning, Aye; Councilmember Kritzler, Aye; Councilmember
Shirley, Aye ;Councilmember Anderson, Aye; Mayor Milbert,

g. CONSIDER ACTION - ENGINEERS REPORT - IMPROVEMENTS BLOCK

Staff recommended that Resolution #88-33 be adopted ordering
preparation of the Engineer's report on improvements in
block 99. This would allow a concrete alley cost estmimate
to be prepared.
Councilmember Redepenning moved and Councilmember Anderson
seconded the motion to adopt Resolution 88-33 ordering
preparation of Engineer'S report on Improvements be adopted.

h. CONSIDER ACTION - BATON PARKING REQUEST

The Baton Corporation has requested the City re-sign First
Street South between 11th and 12th Avenues in the following
fashion: The north side of First street will be signed with
a 2 hour limit between 8:00 a.m. and 6:00 p.m. between 11th
and 12th Avenues and all day parking between l2th and l3th
Avenues. The south side of First Street between 11th and
13th will be signed as no-parking. This will allow the new
tennants and their guests to be able to have short term
parking.

Councilmember Shirley moved and Councilmember Redepenning
seconded the motion to adopt the Baton Parking Request.
A poll of the vote was as follows: Councilmember

i. CONSIDER ACTION - WAIVER OF PLAT - CITY OF HOPKINS
Staff recommended approval of the following motion: That
the request for a Waiver of the Plat to add additional area
for the parking facility be approved. Approval of this
motion will allow the City to construct the parking ramp on
a larger parking area.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion to accept Resolution #88-27 making
findings of fact and approving the application for waiver of
platting requirements.

j. CONSIDER ACTION - CONDITIONAL USE PERMIT - CITY OF
HOPKINS
A petition requesting an Environmental Assessment Worksheet
(EAW). Staff recommended that the request for an EAW for the
parking ramp be denied.
Councilmember Redepenning moved and Councilmember Anderson
seconded the motion to deny the request for an EAW for the
parking ramp.
A poll of the vote was as follows: Councilmember
Redepenning, Aye; Councilmember Kritzler, Aye; Councilmember
Shirley, Aye; Councilmember Anderson, Aye; Mayor Milbert,
Aye. The motion carried unanimously.

The City of Hopkins applied for a CUP to construct a Parking
Ramp on Lot 400. Staff recommends approving a CUP for the
construction of a parking ramp.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion to approve Resolution #88-28 making
findings of fact and approving application for a
Conditional Use Permit CUP 88-6'.

k. CONSIDER ACTION - APPROVAL OF PLANS & SPECS - PARKING
RAMP
Steve Mielke recommended approval of the plans and authorize
the architect/consultant to solicit bids. Mr. Vedi showed
the Council the plans and materials he intends using for the
parking ramp. He also thanked the staff for the cooperation
and help they have given his staff in this endeavor.
Councilmember Anderson moved " and Councilmember Shirley
seconded the motion to approve the plans and authorize

l. CONSIDER ACTION - PARKING IN LOT 600

Brian Fitsinger appeared before Council to recommend leaving
the parking lot alone until a date can be set for a meeting
with all interested parties of this issue. He stated that
the Hopkins Parking Commission approved adoption of removing
all yellow permit parking for Lot #600 on loth Avenue and
post these spaces for 2 hour "on street parking" only.
After discussion Councilmember Shirley moved and
Councilmember Kritzler seconded the motion to remove all
yellow permit parking for Lot #600 on loth Avenue and
posting these spaces for 3 hour "on street parking" only.
A poll of the vote was as follows: Councilmember

m. CONSIDER ACTION - AMEND SIDEYARD ORDINANCE

Nancy Anderson asked the Council to approve the
clarification of Ordinance No. 515-01. The ordinance allows
a zero sideyard setback if the abutting building also has a
zero sideyard setback. The proposed ordinance does not
change anything that currently exists, it only clarifies the
language.
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion to approve Ordinance #88-610 for first
reading.

v. REPORTS - COMMITTEES/COMMISSIONS
o
Councilmember Shirley reported that he went to the concert
that the Hopkins Band had at the High School on Saturday
night and that it was excellent. He also said that Don
Bates is a credit to the city of Hopkins.
Councilmember Kritzler said that last Friday he attended a
workshop session at the Southwest Cable Commission. The
main topic of the day was the impending sale of Rogers Cable
holdings in the United States. The commission is very
concerned about this and watching out for the interests of
the citizens as best they can.
Councilmember Kritzler also attended the Chemical Health
Commission meeting. They reviewed the by-laws by the City
, Attorney and approved all of them with very few questions at
this time. They are reviewing covenants now and hoping to
involve the businessmen in the Community.
Councilmember Redepenning reminded the Council that there
will be an Art Fair this week-end as well as the fun run
with different activities going on.

Mayor Milbert informed the Council that he and Councilmember
Shirley had attended the LRT meetings and recommendations
were made by the advisory board to the County. The City is
still pushing for a part of Phase I and hopefully we will
know by June 1.
VII. ADJOURNMENT
Councilmember Anderson moved and Councilmember Redepenning
seconded the motion for adjournment. The meeting adjourned
by unanimous consent.
