1988-069 , J " CITY OF HOPKINS H nn pin County, Minnesota RESOLUTION NO: 88-69 RESOLUTION ADOPTING MODIFICATION #5 TO THE CBD REDEVELOPMENT DISTRICT (NORTH SECTOR PROJECT) BE IT RESOLVED, by the City Council of the City of Hopkins, Minnesota: section 1. Recitals 1. 01 It has been proposed that the City adopt a Plan Modification #5 Program for CBD Redevelopment Tax Increment District (North Sector project) pursuant to and in accordance with Minnesota Statutes, sections 469.124 through 469.134 and Minnesota Statutes, sections 469.174 through 469.179. 1.02 The Council has investigated the facts and has caused to be prepared a modified Development Program for Redevelopment District No.5, describing the actions to be undertaken by the City to aid the development of property within Redevelopment District NO.5, and has caused to be prepared a Tax Increment Financing Plan describing the specific acts to be taken to assist development within Tax Increment Financing District No.5. 1.03. The City has performed all actions required by law to be performed prior to the modification of the CBD Redevelopment District and the adoption of a modified Development Plan relating thereto, including, but not limited to, a review by the planning staff or consultant of the modified Development Plan for the caD Redevelopment District; and hold a public hearing regarding the Program and the Plan upon such notice as is required by law. 1.04. The modified Development Plan is contained in a document entitled "Modification #5 of the Plan for the original Hopkins CBD Redevelopment Tax Increment District (North Sector Project) dated June 22, 1988, and on file in the office of the City Clerk. section 2. Findinqs Related to Modification #5. . 2.01. The Council hereby finds that the Modification #5 of the CBD Redevelopment District (North Sector Project) is intended, and in the judgment of the Council, will promote certain public purposes and accomplish certain objectives as specified in the Development Program. '\ ., 2.02 The City has previously adopted a Plan for the caD Redevelopment District (North Sector Project). Except to the xtent the modified Program adopted h rewith explicitly or by reasonably nec ssary implication amends the previous Program, such Program continues to be an expression of the intent of the city. section 3. Findinqs Related to Modification #5 to the caD RedeveloDment District (North Sector Proiectl. 3.01 It is the opinion of the Council that the project within Modification #5 to the CBD Redevelopment District (North Sector Project) would not reasonably be expected to occur solely through private investment within the reasonably foreseeable future. 3.02. The Council finds that the Tax Increment Plan for the caD Redevelopment District (North Sector Project) conforms to the general plan for development of the City, based upon the recommendations of the planning staff or consultant, because it calls for removals of a blighting structure needed to promote development in the area. 3.03 The Council finds that Modification #5 CaD Redevelopment District (North Sector Project) will afford maximum opportunity, consistent with the sound needs of the City as a whole, for development of the District by private enterprise by removing blighting conditions. 3.04 The Council further finds that Modification #5 of the caD Redevelopment District (North Sector Project) is intended and, in the judgment of the Council, its effect will be to promote the public purposes and accomplish the objectives specified in the original CBD Tax Increment Plan. Section 4. ADDroval of the Modified DeveloDment Plan. 4.01 Modification #5 to the caD Redevelopment District (North Sector Project) is hereby approved and adopted. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same: .
