RESOLUTION MAKING FINDINGS OF FACT AND DENYING
APPLICATION FOR CONDITIONAL USE PERMIT CUP88-14
WHEREAS, an application for a Conditional Use
Permit entitled CUP88-14 made by Gregory & Rebecca Wellens,
533 East Park Valley Drive, to construct a 6 foot high
special purpose fence is denied.
WHEREAS, the procedural history of the application
is as follows:

1. That an application for Conditional Use Permit
CUP88-14 was filed with the City of Hopkins on
August 5, 1988.
2. That the Hopkins Planning Commission reviewed
such application on August 30, 1988.
3. That the Hopkins Planning Commission, pursuant
to published and mailed notices, held a public
hearing on August 30, 1988; all persons present
at the hearing were given an opportunity to be
heard.
4. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP88-14:
1. That the neighborhood was constructed with the
homes close together.
2. That a 6 foot fence would have an adverse
affect on the abutting neighbor.
3. That the granting of the Conditional Use Permit
for this fence would set a precident for all of
Park Valley to have 6 foot fences between
homes.
