CITY OF HOPKINS
HENNEPIN COUNTY, MINNESOTA
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP87-17
WHEREAS, an application for a Conditional Use
Permit entitled CUP87-17 has been made by Baton Corporation,
to construct a condo/townhouse project on a portion of Block
7, West Minneapolis.

WHEREAS, the procedural history of the application
is as follows:
1. That an application for Conditional Use Permit
CUP87-17 was filed with the City of Hopkins on May
1,1987.
2. That the Hopkins Planning Commission reviewed such
application on May 26, 1987.
3. That the Hopkins Planning Commission, pursuant to
published and mailed notices, held a public
hearing on May 26, 1987; all persons present at
the hearing were given an opportunity to be heard.
4. That the written comments and analysis of the City
staff and the Planning Commission were considered.
NOW THEREFORE, BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
to CUP87-17:
1. That the development meets the requirements for a
P.U.D.
2. That the development meets the requirements of a
Conditional Use Permit.
BE IT FURTHER RESOLVED, that application for
Conditional Use Permit CUP87-17 is hereby approved subject
to the following Conditions:
1 . That the requested variances are approved.
2. That the applicant secures ownership of the
0 property.
3 · That both plans are accepted.
4. That the applicant provide an access plan for the
first two phases.
5 . Landscape plan be amended to provide property
screening but not infringe on the property to the
north.
