1987-055 o RESOLUTION NO: 87-55 CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR CONDITIONAL USE PERMIT CUP87-14 WHEREAS, an application for a Conditional Use Permit entitled CUP87-14 has been made by Jeff Mackenstadt, 1417 Boyce Street, to construct a 6 foot high fence along the side yard abutting St. John's Church. o WHEREAS, the procedural history of the application is as follows: 1. That an application for Conditional Use Permit CUP87-14 was filed with the City of Hopkins on May 1, 1987. 2. That the Hopkins Planning Commission reviewed such application on May 26, 1987. 3. That the Hopkins Planning Commission, pursuant to published and mailed notices, held a public hearing on May 26, 1987; all persons present at the hearing were given an opportunity to be heard. 4. That the written comments and analysis of the City staff and the Planning Commission were considered. NOW THEREFORE, BE IT RESOLVED, that the Hopkins City Council makes the following Findings of Fact in respect to CUP87-14: 1. The fence is necessary to protect and buffer the applicants property from the playground. 2. Use abutting sideyard where subject fence is to be constructed is more intense than that of a single family dwelling. 3. Special Use Fence is allowed by Conditional Use Permit c BE IT FURTHER RESOLVED, that application for Conditional Use Permit CUP87-14 is hereby approved subject to the following Conditions: 1. The fence will be made of cedar and maintained to an acceptable standard. 2. The fence will not exceed 6 feet in height. Adopted this 2nd day of June, 1987. Ellen Lavin, Mayor o
