RESOLUTION MAKING FINDINGS OF FACT AND APPROVING
APPLICATION FOR CONDITIONAL USE PERMIT CUP87-12
WHEREAS, an application for a Conditional Use
Permit entitled CUP87-12 has been made by Mark Eklo to
construct seven townhomes on Oak Park Lane.
WHEREAS, the procedural history of the application
is as follows:

1. That an application for Conditional Use Permit
CUP87-12 was filed with the City of Hopkins on
April 7, 1987.
2. That the Hopkins Planning Commission reviewed
such application of April 28, 1987.
3. That the Hopkins Planning Commission pursuant to
published and mailed notices, held a public
hearing on April 28, 1987; continued the matter
5-26-87, 6-30-87, and finally tabled the hearing
at the request of the applicant on 7-28-87.
4. Case removed from the table 11-24-87; notices
again mailed to affected property owners; all
persons present at the hearing were given an
opportunity to be heard.
5. That the written comments and analysis of the
City Staff and the Planning Commission were
considered.
NOW THEREFORE, BE IT RESOLVED, that the Hopkins
City Council makes the following Findings of Fact in respect
of CUP87-12:
1 . The proposed townhomes meet the requirements for
an R-2 District.
2. The proposed townhomes meet the requirements for
a Conditional Use Permit.
3 · The proposed townhomes meet the requirements for
a P.U.D.

BE IT FURTHER RESOLVED, that application for
Conditional Use Permit CUP87-12 is hereby approved subject
to the following Conditions:
1 . That the applicant meet the requirements of the
Fire Marshal.
2. That the applicant dedicate the road on the east
side of the property.
3 · Drainage be resolved to the satisfaction of the
Council.
