Hennepin County, Minnesota RESOLUTION NO. 85-3203 RESOLUTION DECLARING COSTS TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENTS WHEREAS, certain improvements, all as more fully described in Exhibit A. hereto attached and hereby made a part hereof have been previously ordered and completed: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HOPKINS, MINNESOTA, as follows: 1. That the cost of each such improvement to be specially assessed is hereby declared to be the cost or the amount to be assessed, whichever is . greater, which appears in said Exhibit A. 2. That the City Clerk, with the assistance of City Engineer, shall forthwith calculate the proper amount to be specially assessed fo~ each such improvement against every assessed piece or parcel of land within the various districts or locations affected without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessments in his office for public inspection. 3. The Clerk shall, upon the completion of such proposed assessments notify the Council thereof. Passed and adopted by the Council of the City of Hopkins, Minnesota, ~o this 16th day of July, 1985. J. Project 84-01. Concrete curb, gutter and driveways on the north service road of State Highway No.7 from Robinwood Lane to County Road #73, total cost being $13,079.77 of which $6,932.45 i.s proposed to be assessed to Tracts A, B, C, and G, Registered Land Survey No. 1053 and Lot 2, Block 1, Union Oil Second Addition 7. Project 84-02. Concrete alley between 16th Avenue North and 17th Avenue North from 4th Street North to 16th Avenue North, total cost being $11,224.04 of which $9,296.17 is proposed to be assessed to Lots 1 thru 7, inclusive, and Lots 14 thru 18, inclus'ive, Block 2, Gibb1s First Addition to West Minneapolis. o 8. Tree and stump removal at the following locations: 1. 301-10th Avenue North, Lot 13, Block 99 West Minneapolis Second Division, total cost being $286.00. 2. 22-6th Avenue North, Lot 5, Block 65 West Minneapolis Second Division, total cost being $156.00. 3. 630 West Park Valley Drive, Lot 9, Block 3 Park Valley Second Addition, total cost being $329.00. 4. 101-12th Avenue North, Lot 11, Block 77 West Minneapolis Second Division, total cost being $339.00. 5. 203 Wilshire Walk, Lot 2, Block 2 Knollwood, total cost being $223.00. . '"r ~ SPECIAL ASSESSMENT AGREEMENT o Agreement made this ___ day of June, 1985, by and between JOHN MERRILL and SHEILA MERRILL (hereinafter called 1I0wnersll) and the CITY OF HOPKINS, a municipal corporation (hereinafter called (IICi,tyll). RECITALS 1. The Owners reside at 146 15th Avenue North, Hopkins, Minnesota. 2. The property of the Owners adjoins the public right-of-way bordering Second Street North upon which a retaining wall is located. 3. On April 23,1985 the retaining wall collapsed and unless promptly repaired will cause damage by erosion to Owners' property as well as the public right-of-way. 4. The retaining wall constitutes a public improvement which directly benefits the property of the Owners by retarding erosion of the property upon which their dwelling is situated. 5. The Owners desire that the retaining wall be repaired and the costs be specially assessed to them. 6. The repair of the improvement does not exceed $5,000.00 NOW, THEREFORE, the parties agree as follows: 1. The City shall undertake promptly to construct the retaining wall or in the alternative to review and approve the plans and specifications of a private contractor for such construction upon the execution and approval by the City of the terms of this Agreement the cost of which shall be assessed specially to the Owners all in accordance with Minnesota Statute Chapter 429 as herein made and provided fora term of 10 years at 7% interest.
