01-18-2011A regular meeting of the Hopkins City Council was held on January 18, 2011 in the Council Chambers of the Hopkins City Hall. Present were Mayor Maxwell and Council Members Youakim, Brausen, and Halverson. Also, present were staff members Getschow, Stadler, Bradford, Elverum, Genellie and City Attorney Jerry Steiner. I. CALL TO ORDER Mayor Maxwell called the meeting to order at 7:31 p.m. II. OPEN AGENDA - PUBLIC COMMENTS AND CONCERNS There were no comments III. PRESENTATION 1. Recognition for Ramsgate Apartments in "Engaging Raspberry Renters" City Manager, Rick Getschow explained the Raspberry Renters program and described some of the activities that the residents of Ramsgate and City staff participated in during 2010. Marsha Detloff, Rosalind Foley, and Mary Schenke appeared representing Ramsgate. IV. CONSENT AGENDA 1. Minutes of the January 4, 2011 City Council Meeting 2. Minutes of the January 4, 2011 Work Session after the City Council Meeting 3. Minutes of the January 11, 2011 Work Session 4. Approve Miscellaneous Fee Increases; Genellie Council Member Brausen moved and Council Member Halverson seconded a motion to approve the Consent Agenda. A poll of the vote was as follows: Council Member Youakim, aye; Council Member Brausen, aye; Council Member Halverson, aye; Mayor Maxwell, aye. The motion carried unanimously. V. NEW BUSINESS 1. Approve the Fourth Amendment to PUD/Development Agreement - Marketplace & Main (CR2011-005) Kersten Elverum, PED Director, explained the background of this issue. In June of 2004 the City of Hopkins rezoned the former Hopkins Honda Body Shop and used -car sales lot to a Planned Unit Development (PUD) overlay zoning to facilitate the redevelopment of this site into a mixed-use (residential/commercial) development. At that time, a PUD agreement was executed with Luther Companies. The PUD agreement was revised in the summer of 2006 to reflect The Cornerstone Group as owners. The PUD agreement with The Cornerstone Group was approved by the Council, but never executed. January 18, 2011 City Council Meeting Minutes Page 1 In 2007 The Cornerstone Group sold the site to Marketplace Holdings, Inc., (The Beard Group) and the agreement was amended. In the spring of 2009 The Beard Group proposed to change the ownership of the units from owner -occupied to rental, and the agreement was amended and extended for construction to start no later than October 31, 2009. The agreement has been extended two more times to January 31, 2010, and again until December 31, 2010. Staff is now proposing to extend the agreement to December 31, 2011 for flexibility on the start date. Bill Beard said that they were still waiting on HUD to approve a loan. He also said that if the HUD approval is not forthcoming by the spring it could impact Hennepin County grants designed to help remediate some environmental issues. Council Member Brausen moved and Council Member Youakim seconded a motion to approve the Fourth Amendment to PUD/Development Agreement between the City of Hopkins and Marketplace Holdings, Inc. A poll of the vote was as follows: Council Member Youakim, aye; Council Member Brausen, aye; Council Member Halverson, aye; Mayor Maxwell, aye. 2. Adopt Resolution 2011-003, Authorizing Final Payment of 2008 Street and Utility Improvements, City Project 07-10 (CR 2011- 006) John Bradford, City Engineer, told the Council that the contractor has completed all work on the Minnetonka Mills Road project to the City's satisfaction. This action completes an assessable street project. Staff recommended approval of Resolution 2011-003 accepting work and ordering final payment in the amount of $55,689.90. Council Member Youakim moved and Council Member Halverson seconded a motion to adopt Resolution 2011-003, accepting work and ordering final payment, 2008 Street and Utility Improvements, City Project 07-10. A poll of the vote was as follows: Council Member Youakim, aye; Council Member Brausen, aye; Council Member Halverson, aye; Mayor Maxwell, aye. The motion carried unanimously. V. ADJOURN There being no further business, Council Member Brausen moved and Council Member Youakim seconded a motion to adjourn the meeting.
