78-2659 CITY OF HIPK NS III Hennepin County, Mi nesota RESOLUTION NO. 8 - 59 A RESOLUTION RECEIVING RE ORT AND CALLING FOR HEARING ON I PR MENTS WHEREAS, pursuant to Resoluti.n Isli o. 77 -2645 of the Council adopted December 13, 1977, a report has been ore ared by John Strojan, City Engineer, with reference to the North side of County Road No. 3 from west of Chicago Northwestern Railroad right -of -way (Town Terrace Apts.) to new exit ramp east of Chicago Northwestern Railroad ri kt -of -way by the extension of watermain to provide additional fire •ro ection and to eliminate dead end • main in a high service location thereon nd this report was received by the Council on Febraury 21st, 1978. NOW, THEREFORE, BE IT RESOLVE. by the City Council of Hopkins, Minnesota, as follows: 1. The Council will consider th improvement of such street in accordance with the report and the as-es ent of Lot 9, Lot 10, 11, 12, 13 14, 15, 16, 17, 23 and 26, Auditors S bd' ision No. 242; Tracts A thru F, inclusive, Registered Land Survey No. 823; Lots 1 thru 7, inclusive, Town Terrace; for all or a portion of the most 'of the improvement pursuant to M.S.A., Secs. 429.011 to Secs. 429.11 , s amended, at an estimated total cost of the improvement of $9,108.00. • 2. A public hearing shall be he on such proposed improvement on the 21st day of March, 1978, in the Colin I l il Chambers of the City Hall at 7:30 o'clock P.M., and the Clerk shall give published notice of such hearing and improvement as required by law. VESELY, City Attorney (Official lication) CITY OF PKINS III Hennepin County Minnesota ORDINANCE . 78 -439 AN ORDINANCE ESTABLISHING WRIER AND SANITARY SEWER RATES AND « A Neas:, AND REPEALING ORDINANCE NO. 75 -409 AND ALL THE PROVISIONS OF AND CONTAINED IN SECTIONS 520:05 and 520:20 OF THE 1977 CODE OF ORDINANCE OF THE CITY of HOPKINS. BE IT ORDAINED by the Council of the City of Hopkins as follows: That Sections 520:05 and 520:20 of the 977 Code of Ordinances of the City of Hopkins be and the same are hereby amend as follows: Section 520:05. WATER RATES. The gross rates per water meter shall be $.055 per each 100 gallons of water plus 5% ther f. • The number of gallons of city water f 'shed from time to time shall be deter- mined by water meter readings, and if any su water is used on premises without a proper water meter or whenever such meter is out of order, the amount of water used at such interval shall be determined either averaging previous water bills at such location with the same or similar use, or by e average amount of water consumed at other premises during a similar interval with a similar use or business. Any and all meters may be read by officials of the H kins Water Department either every month or every quarter, but where such readings are monthly, the gross rates as above set forth shall be calculated and applied as though such meters were read quarterly. Section 520:20. SANITARY SEWER SERVICE AND RATES. Subdivision 1. Sanitary • Sewer Service Rates and Charges for Residenti 1 Customers. The gross sanitary sewer service charge for residential custaners saal be $.075 per each 100 gallons of water plus 5% thereof, provided that in arriving at such monthly water consumption for any single family residential custaners, such - use ler and charge shall be determined by using the amount of such water consumed in su h single family dwelling in the annual quarters ending in January, February or March of each year divided by three; provided further that in cases of new construction or ddition to any residential unit, the average water consumption is to be determined by the first thirty day period following its completion or occupancy until the next ensuing quarter ending in January, February or March. Whenever such average water used in any such single family dwellings III during the quarters ending in January, Feb_ua or March may be unfairly disproportionate a ' because of the customer's methods or lack of Aeration or any other reason, then and in the event the City of Hopkins shall establish an average water charge and correspond- ing sanitary sewer charge by the use of s 'table methods which will be as fair as possible, such determination by the City .f Hopkins to be final.
