78-2682 " I CITY 0 HOPKINS Hennepin Co nty, Minnesota • RESOLUTION NO. 78 -2682 A RESOLUTION 0•DE ING ABATEMENT OF NUISANCE BY RE OVING CERTAIN INFECTED EL A D /OR OAK TREES ON /OR IN BLOCK 1, DAVISON'S ADDITION TO WEST MINNEAPOLIS WHEREAS, Pursuant to City of opkins Ordinance No. 73 -382, and pursuant to M.S.A. Chapter 18, and pursuant to Chapter 4, Rules and Regulations of the Department of A•riculture (AGR- 101 -120), the forester of the City of Hopkins has found c.nditions indicating the presence of Dutch Elm or Oak Wilt infestation :xist and have existed upon Block 1, Davison's Addition to West Minneap•lis. WHEREAS, Notice of such findi gs has been given to the owners of record of the premises; and, WHEREAS, No part of said infe•te trees has been removed or other- • wise treated. NOW, THEREFORE, It is hereby •esolved by the City Council of the City of Hopkins as follows: That the premises of said infected trees, which are fifty (50) in number and have been and are duly arked and are located upon Block 1, Davison's Addition to West Minneap•li , constitute a public nuisance as more fully set forth in the provis on of Hopkins Ordinance No. 73 -382, M.S.A. Chapter 18, and Rules and R:gu ations of the Department of Agri- culture (AGR 101 -120), and such nu sauces are hereby ordered to be immediately abated by the cutting .nd removal of all such infected trees thereon. It is further ordered that a 'otice of the intention of the Council so to abate said nuisance shall be published once and a copy thereof mailed to the affected property ow er which Notice shall specify that action upon this Resolution shall •e taken at a special public meeting of the City Council to be held on une 20,1978, such publication to be not less than one week prior to the dte of such meeting. 41, The Council at such meeting seal hear all property owners with re- ference to the above matter.
