A RESOLUTION AUTHORIZING S hOF LAND ACQUIRED
BY THE CITY FOR LANDFILL MA RIAL PURPOSES
FROM RAILROAD 10 ANY
WHEREAS, the City of Hopkins, ■y it Claim Deed dated April 24,
1978, purchased certain premises from Ch ca , Milwaukee, St. Paul and
Pacific Railroad Company located in Henn:pi County, Minnesota, described
as follows, to -wit: ''
All that part of Chicago, Milw,.uk , St. Paul and Pacific
Railroad Company's extra width, ri t -of -way in Governments
Lots 5 and 6, Section 26, To .hi , 117 North, Range 22 West,
III which lies southeasterly of a i drawn parallel to and
distant 50 feet southeasterly f,' treasured at right angles
from, the centerline of the most outherly or easterly bound
main railroad track, and which li s easterly of the centerline
of Hennepin County Road No. 61';e cept road,

WHEREAS, the purpose of said pa ase was to use certain fill
material from said premises to be trans.'urt d to and used by the City for
its sanitary landfill located within one mi e therefrom, and
WHEREAS, after such purchase le ity has entered into a contract
pursuant to which it will be guaranteed Hu icient fill material for the
sanitary landfill purposes above set for h' o complete its operation of
such sanitary landfill in said location ht
price and under conditions satis-
factory to the City, and
WHEREAS, such contract elimina es'i the necessity and ownership of
the premises hereinabove described recen ly purchased by the City for such
landfill purposes, and thus causes the • e,i hip of the land hereinabove des-
cribed to be unnecessary, and
411 WHEREAS, the City has received an offer for title to said above
d escribed premises which is fair and re- ,.on. and compensates the City fully
for its costs and expenditures in conned ic; with such purchase and will fur-
ther promote the orderly development of Ha'. premises and other lands contiguous
thereto and to the City of Hopkins.
NOW, THEREFORE, it is hereby R•sd'ved that the City is hereby authorized,
ordered, and empowered to sell the above d; = cribed premises situated in Hennepin
County, Minnesota, to Donald F. Hagen an• ,.rbert A. Mason by proper Deed, and
the Mayor and Clerk of the City are here'y1. :uthorized to execute all necessary
instruments of conveyance in connection 0 ewith.
Passed and adopted by the Court i1 of the City of Hopkins, Minnesota,
at a regular meeting held on the 6th day o June, 1978.
