RESOLUTION NO. 78 -25187 A RESOLUTION AUTHORIZING SALE 0 ILAND ACQUIRED BY THE CITY FOR LANDFILL MATE AL PURPOSES FROM RAILROAD COMP All WHEREAS, the City of Hopkins, by Qu Claim Deed dated April 24, 1978, purchased certain premises from Chicago ;Milwaukee, St. Paul and Pacific Railroad Company located in Hennepin county, Minnesota, described as follows, to -wit: All that part of Chicago, Milwaukee; { St. Paul and Pacific Railroad Company's extra width rightt -way in Governments Lots 5 and 6, Section 26, Townshi? 117 North, Range 22 West, • which lies southeasterly of a ling dawn parallel to and distant 50 feet southeasterly of, mek.ured at right angles from, the centerline of the most herly or easterly bound main railroad track, and which liras easterly of the centerline of Hennepin County Road No. 61, ex ic, It road, WHEREAS, the purpose of said puraha was to use certain fill material from said premises to be transported �o and used by the City for its sanitary landfill located within one mi_e therefrom, and WHEREAS, after such purchase the Ci has entered into a contract pursuant to which it will be guaranteed suf_i Vent fill material for the sanitary landfill purposes above set forth to I'omplete its operation of such sanitary landfill in said location at a'piice and under conditions satis- factory to the City, and 1 WHEREAS, such contract eliminates th:1necessity and ownership of the premises hereinabove described recently pu ased by the City for such landfill purposes, and thus causes the ownerrh i.. of the land hereinabove des- cribed to be unnecessary, and • WHEREAS, the City has received an of'-r for title to said above described premises which is fair and reason01 and compensates the City fully for its costs and expenditures in connection w L such purchase and will fur- ther promote the orderly development of said p -noses and other lands contiguous thereto and to the City of Hopkins. NOW, THEREFORE, it is hereby Resolve that the City is hereby authorized, ordered, and empowered to sell the above descr •ed premises situated in Hennepin County, Minnesota, to Donald F. Hagen and Herb A. Mason by proper Deed, and the Mayor and Clerk of the City are hereby adthilrized to execute all necessary instruments of conveyance in connection therawj Passed and adopted by the Council )f he City of Hopkins, Minnesota, at a regular meeting held on the 6th day of ;J�i, 1978.
