RESOLUTION RATIFYING RESOLUTION NO. 2012-0059
WHICH ORDERED THE 2012 STREET IMPROVEMENT
PROJECT, PROJECT NO. 2011-10
WHEREAS, on January 17, 2012, the City Council of the City of Hopkins (the "City")
held a duly noticed public hearing regarding the 2012 Street Improvement Project, Project No.
2011-10, consisting of certain street improvements to Minnetonka Mills Road, 5th Avenue N to
western limits; Gethsemane Road; 3rd Street N, 8th Avenue N to 9th Avenue N; 4th Street N, 10th
Avenue N to 11th Avenue N; 6th Avenue N, Minnetonka Mills Road to (approximately) 75 feet
north of 3rd Street N; 81h Avenue N, 1St Street N to 2nd Street N; 9th Avenue N, 3rd Street N to
Minnetonka Mills Road; Alley between 5th Avenue N and 6th Avenue N, 2nd Street N to 3rd Street
N; and Alley between Mainstreet and 1St Street S, 8th Avenue S to 9th Avenue S, by
reconstruction of bituminous streets including improvement to the storm sewer, water
distribution, and sanitary sewer systems; concrete curb and gutter replacement; pedestrian
facility improvements; and the associated boulevard restoration (collectively, the
"Improvements"), all pursuant to Minnesota Statutes, Section 429.011 to 429.111; and
WHEREAS, the estimated cost of the Improvements presented before the City Council
on January 17, 2012, was $3,072,000; and
WHEREAS, the City published and provided notice of the public hearing in accordance
with the terms of Minnesota Statutes, Section 429.031, subdivision 1(a), which notice
inadvertently listed the proposed assessment amount ($1,161,539.63) as the estimated amount of
the total costs of the Improvements; and
WHEREAS, following the duly noticed public hearing on January 17, 2012, the City
Council adopted Resolution No. 2012-005, which ordered the 2012 Street Improvement Project,
Project No. 2011-10 and stated that the total costs of the Improvements were estimated to be
$3,072,000; and
WHEREAS, construction of the Improvements has since commenced; and
WHEREAS, the City has determined to conduct a supplemental public hearing and to
that end has prepared a supplemental notice of public hearing listing the correct estimated
amount of the total costs of the Improvements, which is $3,072,000; and
WHEREAS, the City has given ten days' mailed notice and two weeks' published notice
of the public hearing held on the date hereof, at which all persons desiring to be heard were
given an opportunity to be heard thereon; and
WHEREAS, the City Council held a supplemental public hearing on the date hereof at
which all persons desiring to be heard were given an opportunity to be heard thereon.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hopkins,
Minnesota:
