2013-022 Finding of facts for Massage with in HopkinsCITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 13-22 A RESOLUTION MAKING FINDINGS OF FACT AND PROHIBITING THE ISSUANCE OF ANY LICENSE FOR MASSAGE THERAPIST OR MASSAGE THERAPY ESTABLISHMENT WITHIN THE CITY OF HOPKINS WHEREAS, on April 9, 2013, the City Council discussed the regulation of massage therapists and massage therapy establishments. The City Council expressed concerns on how massage therapists or massage therapy establishments are regulated by the zoning ordinance. WHEREAS, the "Background and Findings" contained in Section 1 of Ordinance No. 13- 1061 are hereby approved and incorporated in this Resolution in their entirety. WHEREAS, Ordinance No. 13-1061 will not be effective until the City Council has approved the Ordinance for second reading and publication. WHEREAS, there is a need to immediately suspend the approval of licenses for massage therapists and massage therapy establishments until the effective date of Ordinance No. 13-1061 for the purpose of protecting the planning process and the health, safety and welfare of the citizens of the City of Hopkins while the study provided for in Ordinance No. 13-1061 is being conducted. NOW, THEREFORE, the City Council of the City of Hopkins, Minnesota, hereby adopts the following Resolution: RESOLVED, that commencing on the date of adoption of this Resolution and continuing until the effective date of Ordinance No. 13-1061, no license for massage therapist or massage therapy establishment within the City of Hopkins shall be issued. This Resolution shall not prohibit any license holder that currently has a massage therapy establishment license and that is operating lawfully in accordance with state, federal and municipal regulation from renewing its license for the currently licensed premises.
